congrats to all who have received their NOA2's...We are trying to be calm in waiting for our's it has been 124 days since our NOA1 and hope to get something soon I would like to have my wife here for Christmas but I am doubting that will happen....I have not posted much because I am working long hours at night but I check in on everyone evry so often other than Marivic there is no one to discuss this with that know what we are going throught. one again good luck to all. why are some people getting approved so much faster than others? I have seen march people and april people (like myself) not yet approved... yet I see people in July and August (1 person) already getting approved for the I-130... crying.gif crying.gif crying.gif now that is NOT FAIR... so just because we sent our application in when they @#(*(% up their system, it means we have to wait much longer? why are some people getting approved so much faster than others? Gogo, don't let this process get to you. It's heartbreaking enough without getting more wound up with the strange things that seem to happen at USCIS all the time.

Majority of the recent approvals are not from CSC. It is CSC that is the issue, not the time that we chose to file our petitions. If we had the luck to get our petitions sent to Vermont or Texas, we would probably have our own approvals by now. It was the luck of the draw and, again, is down to USCISs stupid decision to overflow one of the service centres around that time.

The approval from August was pure luck, someone was probably already working on their April I130 and just as they were about to approve the I130, the I129F got paired with it and approved also. The person had already been waiting 5 months for their I130... Personally, I see this as a bit of light at the end of the tunnel. I can only hope someone will look to approve my I130 and approve the I129F at the same time (it would save me 6 weeks - mid April I130 vs End May I129F).

I'm asking because my husband is probably coming by next month and he will stay here until December, so if we can have everything done by now he wont need to worry to notarize in the USA when he's here with me!

Also, about the bank letter, needs to be notarized or only signed and dated by the bank???

Update on the approved I130 being sent back dillema. I called the USCIS and was informed that I'm no longer eligible for the K3 because I have the I130 approval. I mentioned that I have heard of others who have had their I-130s sent back from the NVC to their service center and she insisted that's not possible. She told me that the only purpose of the K3 is to allow the spouse to wait in America for the I130 approval. So I asked her, why are they approving them at the same time now? She couldn't answer. I asked her why my I129F is still "pending" she couldn't answer. I'm thinking she's mildly retarded. Have these people been informed of the July 30th changes? I don't think so. She simply said "why would you want to pursue the K3 if you have the I130 approval anyway, it's unnecessary" to which I replied, "because the interview wait for the K3 is 2-3 months whereas the interview wait for the CR1 is 10 -12 months and my son has already lived without his father for 15 months, we'd rather not prolong it ANOTHER YEAR!" She then said, "then call the NVC". So that's what I did and was assured that my I130 is safe there and will not be considered abandoned. If they were going to do that they would send me a letter before they do something like that. They told me that the K3 will continue to be processed, it will pass thru their office and onto the embassy and when it comes time to do the AOS the USCIS will request the I130 be sent back to them and they will send it to them at that time. So that's that.

A small piece of information which might explain the tiny amount of approvals we are seeing (taken from another thread):-

The two biggest was obviously the fee increase in late July caused such a massive amount of filings, they stopped processing petitions so they could complete filing and data entry on the new ones.

But the second is news to me. Evidently, USCIS stopped processing petitions for a few weeks back in May/June time when the immigration debate was hot and there was pending legislation to overahaul USCIS and I guess they wanted to see where that was going to go before they went any further. Apparently, they didn't want to waste any unneccesary time or resources working on petitions if they were going to have to go back and start over because Congress changed the rules midstream.

I have my doubts about this. There was a stop in the processing of family based petitions in early April through sometime in May for the H1B flood. They are required to have the petitions approved in a timely fashion so that H1Bs can start arriving by October 1. This meant they had to receipt all those received April 2 and April 3 (as they assumed that those were mailed simultaneously), hold the lottery to fill the available slots. This meant clearly marked family based petitions sat unopened, and unclearly marked ones opened and not receipted. Then they had to adjudicate immediately those in the lottery winner set. This took the adjudicators away from adjudicating family based petitions. Bad luck for March and April filers, no way to foresee the unprecedented H1B flood.

They also had to quickly open all H1Bs received after April 3, and return the fee checks with a letter explaining they didn't make the cut, and they had to return the lottery losers, meaning others waited even longer for their NOA1s.

Adjudicators did not stop work waiting for a Congressional debate. Had they passed legislation, an implementation of the changes would not have happened overnight. So why would they stop and wait. They would have plenty of time after the legislation passed and was signed into law. Do you think all those CSC and VSC workers showed up and sat at their desks watching CSPAN? They were adjudicating (maybe slowly for our tastes, but adjudicating). Also, the frontlog of late receipts is not taking adjudicating resources away from all family petitions.

Wow... They have my file since April...only one touch...on May/5 (see my timeline bellow) I wait for 3 months just to get the NOA1...This process is just too much ....I'm already losing myself...I cant wait to go home!!!! :(

The information quoted was given during a face-to-face meeting (infopass?). I had thought this was more knowledgable than the mis-information line. Maybe the officer just said a few things to placate this particular person... but it seems strange just to pull the second excuse out of thin air. It doesn't sound like the normal USCIS spiel.

Looks like conjecture from just another USCIS employee such as:

If the petitions are paired, they will get adjudicated together, not I129F well before the other. The USCIS employee essentially confirmed they are paired, then like a typical misinformation line worker with outdated info said I129F adjudicates well before I130. Seems like just about everything said could have been conjectured just as well by the misinformation line. The real benefit from the drive was that the OP knows his affidavits, marriage license, etc. are in the system. And by the judgment of the person he met with is good enough (which is reassuring).

Really the whole "they stopped and waited for congress" is a bit much. The problem with the whole immigration reform debate in congress is that it didn't address the issues concerning us. Reform to immigration is needed. There should be no need for us to wait this long for adjudication. But the debate would have had little impact on K visas and CR1 petitions for spouses. So because congress was considering a temporary worker visa for people who are currently here illegally and possibly reforming immediate relative I130 petition processing but not for spouses, they stopped work on spousal petitions and all K visas? Had the legislation been passed, in a few months they would have been inundated with the new petitions for the temp workers, sure, and that would cause a delay for us. But the rules for K visas and spousal I130 adjudication were not going to change midstream. The immediate relative I130s that might have changed would be other than spouse (want to bring your brother? ok what merits does he have other than being a USC's brother?, no special work skills etc., oops have to reconsider that petition I was looking at last month). So if worried about midstream adjudication rule changes, they should have stopped work on all non-spousal I130 and thus freed more adjudicators for K visa petitions and spousal I130 petitions.

They most likely continued with business as usual during the debate. Maybe morale was low facing the prospect of being inundated with the petitions from the current illegals but that too is conjecture and is very different than stopping work and waiting.

The information quoted was given during a face-to-face meeting (infopass?). I had thought this was more knowledgable than the mis-information line. Maybe the officer just said a few things to placate this particular person... but it seems strange just to pull the second excuse out of thin air. It doesn't sound like the normal USCIS spiel.

04/18/2008 - both of us are home at last, POE JFK!

05/21/2008 - sent AOS and EAD

05/27/2008 - received NOA1 for AOS and for EAD

06/02/2008 - received Biometrics appt letter

06/19/2008 - Biometrics appointment scheduled - DONE

06/19/2008 - both AOS and EAD touched because of biometrics

07/29/2008 - EAD approved.

05/13/2009 - AOS Interview - APPROVED!/ Card production ordered email

05/18/2009 - Welcome Letter received

06/12/2009 - Second card production ordered email

06/19/2009 - Approval notice send email

06/22/2009 - Green Card received

04/09/2012 - Applied for Citizenship by Express Mailing N400 to NBC

04/10/2012 - N400 received by USCIS

06/23/2012 - Biometrics appointment

07/27/2012 - Appointment scheduled for N400 interview

09/05/2012 - Interview passed, oath ceremony completed, and Naturalization certificate received.
