Hello All ...

Thanks for this chart G & A ... its really good to see some green lines :) ... However I have not received NOA2 yet for I130 ... i was hoping it to be around Sep 1 acc to the chart and my calculations ... What number can I call to find out about it ... I called 1 800 375 5283 ... but never got a cust. representative ... its always a message tape...

Also the website status for 1130 and 129f is not changing at all ... I received a mail notice of case transfer in end of July but the website case status has not changed at all ... It only says 129f application was received on July 6th ... Who can I call about this?

I am really getting worried now as sep 1st has passed and my case status on website has not changed at all ... no touch or update :(

did anyone else had this problem??? :unsure:

Well, it would help if i understood what you mean....

We were married in karachi, Pakistan, so the way I understood it, we filed an I 130, and then all of our info would be sent to Islamabad and then my husband would be sent forms for his medical and police report to be done. Also, I tought that I would have to show that I would be able to sponsor my husband as well. I am sorry, but this is somewhat confusing cause of all the darn forms for this and that ....I am not sure now what I should be doing.

Any help would be greatly appreciated.

The I130, once approved, will be sent to the National Visa Center (NVC), which will do some further processing (might take a month, might take longer) then send it on to the embassy. The embassy will send instructions to your husband on getting his medical, police cert, and other docs together. You will also need to fill out the I864 affidavit of support. This is the CR-1/IR-1 visa route. It will result in a Green Card upon your husbands arrival (with conditions if your marriage is for less than 2 years which must be removed 21 months after he gets it).

The K3 is a non-immigrant visa. It might be faster than the CR-1. to go this route, you would now file the I129F using your receipt from the I130 as proof of having filed it. The K3 petition (the I-129F) goes through the NVC in about a week once it is approved by the Service Center. It might even get processed faster at the service center (historically this was true, but does not appear to be the case any longer). It is a non-immigrant visa, so he would have to file AOS (adjustment of staus to legal permanent resident) once he got here to get his "green card". The AOS application expensive with the new fees going in effect on 7/30/2007. Even though it is non-immigrant, he would still need a medical, police certs, etc. You would most likely have to file a I134 (affidavit of support that is not a binding contract).

Don't worry, you and I are on the same boat. We have very similar dates on both I130 and I129 and I haven't gotten anything either

The thing to remember is that Robin got the I130 petition in before the severe receipting delays really. My receipt date and notice date are 3 weeks apart for that one, but only 1 day apart for the I129F as that was from Chicago, and past any receipting delay they had there.

That is very interesting. The USCIS claims to be going by the receipt date, yet Robin's NOA2 shows the receipt date as the notice date. This makes for a very disappointing hypothesis. :huh:

Exactly, three weeks delay for us and how long for those who filed later? Time is only relative to us anyway.

Not really sure why you think the hypothesis is disappointing. For us, lits neutral. When the backlog lessens/clears, it should be a source of hope. For example, people who had their petitions received on say July 28 may indeed have a notice date that is later than say someone who had their petition received on August 14, and awfully close to if not later than someone who had their petition received on say September 10. But by promising to honor the date stamped as received on the packet in the mail room that person from July can at least hold on to the hope of being processed before the other 2. For us, yeah, it doesn't mean anything positive, as the notice dates and received dates were further apart for people who filed in the time immediately after us, so it doesn't matter which date they go by. But, I wouldn't label it disappointing. Neutral for us, a source of hope for people who file closer to the clearing of the backlog of receipting.

Yes, I had this same problem. My case was transferred on July 12 to VSC. FINALLY on Sept 7 the status changed from "transferred" to "pending". Then I got three touches in a row.. since then, nothing.

I have followed your advice and contacted the NVC in order to send back the I-130 to Vermont for the AOS when the time arrives. They claim that their preferred method of communication is email. I plan to print it out and send it via snail mail as well (including that I already sent this as an email). I will try to call them when I get home from work but based on what I read in other threads, it's not likely that I'll get through. In case anyone else is interested in how I went about this I'll copy the letter here. I'll let you know what kind of results I get.

I just wanted to let everyone know that we finally received our paper NOA1 receipt notices for our I-130 as well as our I-129F.

I have updated our signature line with all the dates found on the notices so our spreadsheet entry can now finally be brought up to date.

p.s. By the way, the Direct File bought us nothing because even though we sent it directly to the CSC (per the USCIS update) they ended up transferring it straight to the MSC which then issued our MSC number and then transferred it back to CSC. Oh well, all in all it doesn't appear to have cost us any additional time as best as I can tell.

I'd been away on vacation for 2 weeks and am a bit disheartened not to see many NOA2s issued during that time :( I was hoping to see at least a few of the people in here finally get their NOA2s. It would have been a glimmer of hope that mine might be approved within the next month.

I also noticed on the USCISs processing page that they are stating "months taken to process petition" instead of "oldest date processed". So I129F K1s are now showing "6 months" instead of "Feb XX 2007". I wonder why they've suddenly changed their format :wacko:
