I am starting a new thread for all those filing I-130's in May and June. I am going to be filing in 1 to 2 weeks.

Hi - this is Mariepa and Will

We filed our I-130 on 9 April

The NO1 was issued on 8 May

We filed our I-129F on 11 May

The NO1 was issued on 16 May

All we know is that this I-129F for a K3 visa application was transferred to the CSC (initially filed in Chicago like the I-130)

I check the USCIS website every day and there is never any update on either the I-130 or the I-129F - this is becoming really depressing...

Dates are for both I-130 and I-129F, K-3

9/4/2006 - Approved (Notice Date)

9/6/2006 - Post Marked (Mailed)

9/10/2006 - Received in mail

For my I-130, it states the "Priority Date" was 4/2/2007 for a Receipt Date of 4/9/2007.

Hi Divine,

My I129F did the exact same thing as yours, only the month early. It was "missing" from early June to August 10.

I agree with G&A, except if you really don't want to pursue the CR1, you should also contact the NVC and ask them to send the approved I130 back to USCIS for storage. Contacting the USCIS is fine, as is not paying the NVC bills, but you will need that approved I130 fir AOS later, and you don't want them to think you just abadoned it altogether, but for it to be held by USCIS for later.

Hey G&A got a lil news. The website finally went from "you're case was sent to Vermont" to "your case if now PENDING"!!! It only too from July 12 - Sept. 7 but I'll take it! I've spent almost two months thinking the I-129F was lost somewhere. Now I want to know, WAS it lost and now it's found? Am I at the back of the line? Was the rec'd date back in July and they just got around to updating the website? Too many questions to ponder. I'm just happy I'm not lost WOOO HOOOO

also, I'm thinking about having the I-130 sent back from the NVC to Vermont. I can't take the stress of one case let alone two! I know in the long run the CR1 is the better option but right now my son wants his daddy and so do I!!! I'd rather worry about the future in a future in which he's standing next to me.

Anyone know how to have the NVC send it back to the VSC?

Thank u urge. I will have it sent back. I think their preferred method of contacting them is email so i'll do that.

It's not the best visa but the K3 is going to be faster for us, i'm sure of that with the way our embassy schedules interviews.

Hello Mariepa, thanks for sharing your info. I will add you to the table. Was your 129F transferred to CSC? and when? also, does it say pending at CSC? if so, when did this happen? these dates also are tracked in the table.

Divine, yes this is totally possible. What the poster there is thinking of doing is entering the US on the non-immigrant K3. The original stated purpose of the K3 is to wait in the states with their spouse until an immigrant visa is available according to the LIFE act. She will stay with her husband and not adjust status (at least not file right away, and assume that NVC processing will complete before the 2 years on the K3 expires). When the NVC processing is complete, it will be forwarded to the embassy where the CR-1 interview will be scheduled. They can go back to the home country for that interview and if successfully approved, return on the immigrant visa (thus getting green card in the mail shortly after arriving) and not need to do AOS and pay $1010 and wait for USCIS to process another petition.

Anyone can do this. Those who have their I130 forwarded to NVC are in a more advantageous position to do this. But even those that don't can still pursue this. For example, if I get both petitions approved together, and the I130 is held and the NVC gets I129F, we can get the K3 and my wife can come. Then we can file the I824 to get the I130 going again and sent to NVC. Pursue consular processing, and send her back to Barbados for the interview. This is something we might do, afterall, the trip is not that long or expensive (as it might be for others, including yourself Divine), and it will make a nice trip to visit her family. But we have to hope that the I824 is processed by USCIS and that NVC processing is finished, and that the interview is scheduled before the 2 years on the K3 is up. You would almost surely get that done since you are already at NVC.

Wow that's interesting. It would cost us more to fly back for the interview than it would cost just adjusting the status here. I see how that could be helpful to some though. Thanks!

Thank you. All the dates I can gather are in my signature. I didn't quite get what you were asking. I think the Priority Date has something to do with authorization or eligibility for NVC to issue a visa number. The Received Date in my signature is(are) the dates that USCIS physically received my application in the mail and signed for it from Express USPS Mail. I hope that answers your question.

There is no Priority Date listed in the I-129F box. There is one only for the I-130. I believe the reason for this is the Priority Date is related to an Immigrant Visa application; whereas we know, the I-129F is for a Non-Immigrant K-3 Visa.

OKAY, wait. I have all the NOAs in front of me. Here we go...

I-129F:

NOA1 (Receipt Notice): Receipt Date: April 22, 2007 ; Notice Date: April 25, 2007

NOAT (Transfer Notice): Receipt Date: April 25, 2007 ; Notice Date: May 11, 2007

NOA2 (Approval Notice): Receipt Date: April 25, 2007 ; Notice Date: September 4, 2007 ; Valid from 09/04/2007 to 01/03/2008

I-130:

NOA1 (Receipt Notice): Receipt Date: April 2, 2007 ; Notice Date: April 9, 2007

NOA2 (Approval Notice): Receipt Date: April 9, 2007 ; Priority Date: April 2, 2007 ; Notice Date: September 4, 2007

It appears the I-130 NOA2 Approval Notice's Priority Date reflects when they first received the application. I believe that is on there due to visa number issuance at NVC.

On the I-129F NOA2, there is no Priority Date. It is blank in that box. The Receipt Date on the NOA2 is the Notice Date from the NOA1. (Same for the I-130 -- The Receipt Date on the NOA2 is the Notice Date from the NOA1.)

That is very interesting. The USCIS claims to be going by the receipt date, yet Robin's NOA2 shows the receipt date as the notice date. This makes for a very disappointing hypothesis.

Thanks Robin for taking the time to post this information. It appears that the 129F is honoring the filing with MSC and not the transfer to CSC. This is good to know. thanks again.

The thing to remember is that Robin got the I130 petition in before the severe receipting delays really. My receipt date and notice date are 3 weeks apart for that one, but only 1 day apart for the I129F as that was from Chicago, and past any receipting delay they had there.
