If you did signed up to get updates on both of your cases then you 'll get a CRIS/USCIS online update email, which I believe is auto generated... And once the case is transferred to the respective service center.. it still retains the SAME case# which was assigned to your case initially from MSC.. Its still MSCxxxxx. I dont think the case number changes.. Anybody has a different take on this?

Thanks Pkewl, it does! I didn't know they'd keep the same case number. I did sign up for email updates but I haven't had any notice that VSC received it yet, or any touches since the NOA1. Hmmmm, looks like things are so backed up at VSC now that they can't even acknowledge receiving a transferred petition! I wish they'd issue some kind of statement about what's going on like CSC did.

Yep, I am still waiting for an email and status change telling me CSC has got my I129F. Others who got the transferred email after me have already seen/gotten these.

Just wondering if anyone who is waiting for a NOA2 had tried calling the NVC to see if your petition had arrived there, even if you didn't get a notice, touch or email? With what's been happening with the NOA1 paperwork, and I thought I read someone else never got a NOA2 in the mail, but found out their petition was already at their consulate - I was wondering if any of our petitions were actually further along than we thought?

Ok. I'm hopelessly hoping there's some screwy reason why nobody's got a NOA2 yet.

yes there is something screwy... You applied for a K3 and followed the USCIS instructions but sending an I-130 followed by an I-129F. You should not be put in this situation where your I-130 is being processed as an IR-1/CR-1 without consideration of the I-129F... If i were you, i keep calling the USCIS until i get a good answer from the IO.

I don't think this is really anything screwy. Yes, they did petition for a K3 when they submitted the I129F. They also petitioned for a CR-1/IR-1 when they filed the I130. The law that created the K3 stated that its purpose was to allow spouses to enter the country as nonimmigrants while their I130 was pending. This was back when I130s were taking more than a year to process. If an I130 is processed really quickly (as in 1 month) it doesn't mean the petition should expect or demand that their I129F get processed just as quickly.

The two petitions are processed independent of each other. The original theory being that the I129F would be processed quicker. Now, there was some anecdotal evidence here on VJ recently that the CS started getting the two petitions together and approving them the same day (then NVC gets the I129F and USCIS holds the I130 for AOS). This may be what they are trying to get to, and it will be easier after July 30 when the 2 petitions will be sent in the same envelope. But, because of the delayed NOA1s and consequently late mailings of the I129Fs of many of us, it is possible that this won't happen. For you and me, its probably not a worry, as both are sitting at the CS and they can do that if they want. But RocksAnne got her I130 worked on and approved before they receipted her I129F.

Before the reports here of the 2 petitions being approved the same day, and I130 processing started to improve, there were plenty of members in the race condition between the 2 petitions as what RocksAnne might see (depending on if/when her I129F is approved, and some members even successfully used their K3 interview time for the CR-1, but I understand the the different Canadian consulates that process these visa types might make that impossible for her). Only time will tell what they will be doing in the future.

I totally agree with the above. The issue is that the applicant should not be left in the dark. Applicants were told to file a 129f since the 130 was taking long. then the 130 process is improved. you would think they should inform the applicants to not spend the $170 along with the 129f because the 130 processing has changed. Also, if the applicant is expecting a 129f approval and a non-IV (with the i130 being held for the future AOS) and the applicant receives an i130 approval instead along with all the NVC associated paperwork and bills, the applicant is left confused as the paperwork did not include any explanation that the 129f process is being abandoned or that USCIS is aware of the 129f filing but they are changing the case to a CR/IR because of the 130 processing time improvement. I am sure you get my point. We should not be googling the Internet and searching forums for this info. well anyway we do :) i just feel bad for all these applicants that have never heard of VJ.

I-129F Check was cashed yesterday (07/11/07)!! :DSo happy!! Every little bit counts.. one more step closer to having mi amor in my arms again!! My brain is now trying to remember and understand what i keep reading and re-reading regarding next steps and approximate times of waiting in between. I've added extra time in my guessing due to what I've seen lately with CSC. I just wish I werent so tired by the time i get online after work.. Anyway.. I plan to get copy of cashed check so I can see # in back. I hear theres a difference in last digits or something like that from whats on uscis site... If anyone knows refresh my memory for next steps and case number in back of cashed check. Thanks, Shoukron, Mahalo!!

Yes, there seems to be a discrepancy between the number on the check and what the case number actually is. When you try to add the new case number to your online account, if it says it can't be found, then try adding +1 to the last number. (for example, if the last number is a '4' add +1 to change the number to a '5') However - you might still get an 'error' message for awhile as some people found it took several days for their new case number to show up online - and I think there was also at least one case where the numbers were off in other ways. (??)

As for the wait time for the next step.......I can't flog that horse any more tonight! I'll let someone else fill you in. I'm going to go drown myself in a gallon of chocolate something or other!

G&A thanks for the link, I hadn't seen that. But I'm confused if he's suggesting that they would hold back the I-129F if your I-130 was approved? Or just saying wait and don't waste the money because he thinks it will go thru before the I-130? My way of thinking is that since the stats are showing it's likely I will have to wait a few months even to get the I-129F *approved*, I might as well keep the I-130 moving along it's track of '4-6 months of paperwork'.

Anyway, another thing I was wondering - I was reading somewhere that the NVC schedules the I-130 consulate appointments? Is that a new thing or has that always been the case? I thought Montreal scheduled them, and everyone was complaining they were very slow at scheduling. So if NVC is (now?) scheduling interviews in Montreal, maybe the I-130 interview appointments won't be taking as long anymore? Or do I have that all mixed up?

If both are approved, then they both keeping moving through NVC. However, when the I130 is on station at the consulate, they will not schedule a K3 interview. At this point, they will only do the CR-1 interview.

Also, it doesn't have to be 4-6 months. You could get lucky and it could go faster for you! Also, with James' shortcuts, it should get through NVC in 2-3 months only.

RA, i think what he is saying is that drag your feet with the 130 so that you can get let the 129F take its coarse. but to your point, if the 129F will take long, i am not sure.

Here is my calculation. I-129F takes 4 months from NOA1 so expect approval by mid Oct. , 15 days processing at NVC and 2 months to get the stamp. so you will have a k3 by say end of Dec. now the i-130 route. NVC will take 3 month, Montreal (Since Vancouver only does K3s) takes another 3-4 months so you are looking at mid Jan to mid Feb.

you have keep both horses in the race but you run some risks such as transferring your K3 to Montreal and/or USCIS completely abandoning the 129f app.

I-130:

RA, i think what he is saying is that drag your feet with the 130 so that you can get let the 129F take its coarse. but to your point, if the 129F will take long, i am not sure.

Here is my calculation. I-129F takes 4 months from NOA1 so expect approval by mid Oct. , 15 days processing at NVC and 2 months to get the stamp. so you will have a k3 by say end of Dec. now the i-130 route. NVC will take 3 month, Montreal (Since Vancouver only does K3s) takes another 3-4 months so you are looking at mid Jan to mid Feb.

you have keep both horses in the race but you run some risks such as transferring your K3 to Montreal and/or USCIS completely abandoning the 129f app.

So by this analysis, if RocksAnne can shave a month off of her NVC time for the CR-1 using James' shortcuts, there wouldn't be much of a difference between the two? Also, remember, she has an approved I130 and an assumed adjudication timeframe for the I129F.

RocksAnne, I am interested in knowing if you looked at James' shortcuts and are you going to give them a try?

ditto...I think every week...surely this must be the week. Then the weekend comes and nada. Lately there has only been 1 or 2 approvals per week it seems like...not very encouraging.

According to my VJ timeline, I should have been approved back in May! haha

Anyway, I wrote my congressman today....going to see if that helps at all.
