can you tell me please what will happen after I-130 and I-129F is approved.??

what will they want in their letter from us? Can we choose which of our cases continue its process in the NVC?

Or I will come to the US first through I-129F? I am very confused after I read the table of your process.

Hi Amoro,

Divine Mercy's timeline is not a common one. She was originally told that her I129F was cancelled because her I130 was approved much much earlier and she HAD to follow the I130 path. When she found out her I129F was approved, she stopped the I130 and continued on with her I129F only.

For most cases, this scenario does not happen because USCIS either hold the I130 for adjustment of status, or administeratively close the I129F... locking you into one path.

If the I130 NOA2 states that the "spouse is in the US" that means USCIS have made the decision for you and will hold the I130 for your adjustment of status. If you decide that you want the I130 to continue on anyway, you can file another form (mentioned on the NOA2) to "kick start" the I130 back on the way to the NVC. This additional form will take roughly 6 months to action and will cost additional money.

Im on my way to my husband this Saturday too. Praise the Lord it seems to be moving..although we still havent received any packet. I emailed them back stating this and asking for advice.. whether he should go there to get another packet, or if possible they can email it to us.. or ??? Anyway, will check what they say back to me.

Oh..just another update.. got the packet in the mail today :dance:

Hello everyone,

Here to update you on my case. I called NVC last night just to hear once again that my I-129 had not been received at the NVC and it was 4 weeks yesterday since approval. I just got off the phone with USCIS and talked to an amazingly nice, helpful lady. Usually don't come across ones this nice from there. I told her the problem and she got on the phone with NVC to see if my information had made it to NVC and, of course, they told her no. She got back on the phone and took my home phone number, cell phone number, and my name, and said she was ordering my file back from the National Records Center because she thinks maybe they forwarded the whole file, I-130 and I-129, there instead of splitting them up and forwarding the I-129 to the NVC. She said it should take no more than 4 weeks for it to reach the NVC. She said it could take up to 2 weeks for the file to come back to her. She actually gave me her name in case I had not heard from her in the two-week time period she gave me. I actually felt like I was treated like a human with feelings for a change. I hope that is all the problem is and maybe it won't take the two weeks she told me. I can only hope!

sorry I missed this before.. C&J summed it up. My I130 was approved w/in about a month of filing so they decided that since my I129F no longer had a pending I130 it was going to be canceled. They apparently forgot to mention this "new policy" to the adjudicator because he/she approved the I129F rather than terminating it. Once you have both approved you have nothing to worry about. They will forward your I129F onto the NVC and get you off to the embassy for a K3 interview. You're all set.. and congrats by the way!

From what I have been seeing.. correct me if I'm wrong.. I paid the pre-July 2007 fees for both petitions. The new trend seems to be that those who filed after the fee change, those who did not pay an I129F fee, are being terminated. Maybe the fact that I paid for the I129F is the reason they approved it. Who knows. I guess it's fruitless trying to make sense out of a chaotic system.

My husband is about to come out of his skin. We were talking on the phone tonight and he says that next month, it will be a whole year since he has set his eye on me, and he needs me so much. I need him so much too and I think this whole immigration thing is an utter mess. Let's just hope that they don't take two long weeks to get my file back to USCIS to see if they forgot to separate my I-129F away from the I-130 and send it to NVC. I had a nightmare the other night that the K3 wasn't in there and they couldn't find it. Oh God, that was a horrible nightmare!

Thanks Cheryl, but there is a worse twist to the story. I was reading in another thread where this person was told by someone named "Becky" with a thick Asian accent had said her file was put on hold because she called the RFE line too much. Guess who I talked to last week who I thought was so nice and helpful??? You got it, Becky with the thick Asian accent, but she was helpful to me, or so I thought. Now I am wondering after reading that post if she will really do what she said she would and whether it would really take 2 weeks to get a file sent back from NRC??? I hope my nightmare is not about to come true!!! I will just keep praying and keep hoping all your good thoughts coming my way make a difference.

Case Complete : 8/25/2013

"Ready for Interview" (Ready to wait for 1-3 Months, this is official NVC letter transfer date) : 9/9/2013

DHL Tracking : arrived 9/24/2013

P4 Letter : 11/21/2013

Interview Date : 12/9/2013, originally 12/3, stupid lawyer filled out her dad's passport number wrong..

Interview Passed : 12/9/2013

Visa "Issued" on CEAC : 12/10/2013

Good evening everyone,

First of all, I want to extend a big congratulations to Gogo for his recent approval. It is about time guy!

Secondly, I would like to update everyone on our case. I called USCIS as it has been two weeks since they said they had ordered my file back from NRC. According to the lady that answered, my file arrived yesterday and was now on "Becky's" desk. The lady said that Becky said she will personally be mailing our K3 petition to the NVC, so check with NVC in about 2-3 weeks. It should get there this time. So I plan to start calling on March 7. I estimate my husband will get a May interview date as the latest I have seen scheduled for Lagos on here is April 22. So I will update everyone once I find out our petition is finally at NVC.

07/06/09: Received Notice of Intent to Revoke

07/27/09: Sent in evidence disputing investigation findings

07/30/09: Case processing has resumed

Deb, I think you're right, May sounds about right. Let's hope on early may! They aren't filling the slots all that fast it seems. I'm sure you will be within the beginning of May!

Yes, Kathryn, and you know what? Even though I was hoping to have a sooner interview date, May just actually might be better as we are getting tax rebate checks starting in May, so my tax rebate check will more than likely pay for my husband's airline ticket to come home. Everything may be working out for the best now that I think about it.
