Hi Amoro,

You won't know what evidence they are wanting until you receive the RFE in the mail. When you get it, it will tell you what they need. Just follow the directions and mail them back what they are requesting. I got my RFE in the mail yesterday and sent the evidence they wanted as well yesterday by express mail. Don't worry too much about it. I pray once you give them what they want, they will resume working on your case quickly and your approval will be coming soon.

Good luck,

Deb

Thank you very much, Deb!

what did they ask you for ?

what can an Evidence be? is it for example photos from wedding, or ...

I will pray for you that you will get your approval very soon.

You are welcome Amoro. I had noticed last month when I was checking what I had sent in for my I-130 and found that I only sent the first page of my divorce decree (Deb kicks own butt). They wanted a copy of the entire decree, especially the page with the judge's signature and my ex's and my signature showing that it had been finalized. By only sending them the first page, it showed it had been filed, but not finalized. I made copies of every page and had sent them that last month, but since they had not requested it yet, they evidently did nothing with it except throw it away. They have it now, so hopefully my case will resume quickly and we will see our approval. I hope and pray you get a quick approval after you send them what they want also.

Good luck,

Deb

You are right ! I got a RFE for do not send all divorce decreee pages and the pics were the wrong size.

You know we get crazy for having RFE to answer but from what I have seen it is all about minor mistakes.

We got approved a few days after sending the documentation back to them.

Dont Worry ! Good Luck

that's a big-### excuse from them.. According to a June 21 article.. after June 21, you can file AT THE SAME TIME.. but before that, we had to follow the "old" instructions of filing I-130 first.. since they are just BEGINNING to process my case, they are using the new rules against me (as well as others here)..

Hello everyone!!

Gogo, Deb... on one hand I am happy to see you are still here (I decided to take a break from this forum); on the other hand, I guess the fact that we are still here is not such good news. But today is the last day of 2007 and I am sure 2008 will bring us the news we are all waiting for.

- Gogo... I have NO idea what they told you that thing of sending the I-130 and the I-129F at the same time!! I read the instructions over and over again and it clearly said you had to send the I-129F ONLY after you had received the NOA1 for I-130. In any case, that is what I did and I am sure that is why my process is taking so long.

Anyway... just wanted to wish you an EXCELLENT 2008... with NOA2s in the first week of January.

Happy 2008!

This is what I did too. I was calling them every other day since the beginning of December. They finally put my case on an adjucators desk but its sad that we have to wait over six months before they would even pay attention to us.

Hopefully all of us May and June filers get our approvals soon.

Following Deb's steps, I called USCIS (again, for the 4th time), using the RFE trick. This time I got a nice guy who confirmed my fear: basically when I sent my I-129F in August they took my I-130 (sent in June) and stapled them together in the August pile. Since I am cleary outside their normal processing times, he promised to give my documents to an adjudicator. Let's see if that happens.

But he shared with me some additional information that you may find interesting: According to this guy, they are working on July cases for the I-130 and August 6th cases for the I-129F. I know everyone at USCIS will tell a different story, but in case this is true, I assume a lot of people will find this information interesting.

Juan Carlos.

Hello Juan Carlos,

Thanks for the info. My timeline is exactly like yours and looks like I have the same problem. I talked to a guy who said he would send a message to the officer handling the case. Lets hope we get approved :)

June 19th - NOA1 - 130

Aug 14th - NOA1 - 129F, Received date - July 23rd.
