*** K-3 May and June 2007 Filers ***

Hello everyone,

I want to congratulate everyone who has been getting your approvals!!! However, I have been getting depressed watching those who filed before me, those who filed at the same time as me, and those who filed way after me getting approvals and there is nothing for me, not even a touch. Since I am now two weeks over processing time, I decided to give USCIS a call this afternoon. Good thing I did because they had our petition sitting in an "A-file"???? I am not sure what an "A-file" is, but it was not in a place that an adjudicator was going to look at it. She at first said that it would be January or February before it would be adjudicated. I then asked what date did they honor on the I-797, the received date or the notice date? She said, the received date. I then stated that if that is true, then my petition is out of processing time because the date on mine says May 18. She then asked if I had filed an I-129F and I told her yes, that I had to file in the middle of August since I needed another passport photo of my husband which he mailed on June 29, but it didn't reach me until the beginning of August. She told me, "Oh that makes a difference. You filed your I-129F after the fee increase so you didn't have to pay a fee. That then puts your I-130 out of processing time." She said she would pull my file and put it on an adjudicator's desk to be looked at and that I should expect a decision within the next 30-60 days. God I hope and pray it doesn't take that long!!!!! We have already been waiting for six months as it is. I have been very patient, but now I have to admit my patience is starting to wear a bit thin and it gets very depressing seeing everyone being approved and I think I am about one of the last ones on G&A's chart that has not been approved. Hopefully, this lady did as she said and maybe I will see an approval in the next week or so.

I dont think/hope it will take that long...half the time these people dont know what they are talking about. They once advised us to comit visa fraud by entering through the VWP and staying in the US hahahah. Stay positive (i know its difficult) your time will come...hopefully sooner than later. Our prayers are with you :)

On the website for our applications both applications are still pending. We received the hard copy of NOA2 on November 26, 2007. CSC just can't get there ####### together... :wacko:

YES, I agree with you My Honey. When my I-129F was approved I DID get the email notification, and the website status IS UPDATED. But when my I-130 was approved, the status on the website NEVER changed, and I never got the email notification...UNTIL NOW. WOW, NEWSFLASH, I'M APPROVED....Hello USCIS, I already knew that. The approval email just came in yesterday for my I-130.

Anyways, we keep learning new things everyday. New ways of USCIS screwing us over. I'll feel safe when I know my I-129F has reached NVC...I want to get out of USCIS HELL.

I never even got an email and I still dont have the NOA2.. I just know cause I checked online....

Dave, your wrong in that Kathryn has now joined you on the CR1 track as of yesterday.

Her situation is very similar to yours, I130 approved long ago, still waiting for the I129F. She had decided to wait for the K3 because of the shorter wait for interview at Lagos while you decided to pursue the CR1. Yesterday, she called VSC and found out that because she no longer has an underlying I130 pending, they were canceling her I129F. So no K3 for Kathryn, CR1 all the way. :thumbs:

Oops, sorry guys I didn't see that previous post. I wouldn't be surprised if they did the same to me but there doesn't appear to be any mention of it as of late. I'm currently just waiting for my packet with the DS230. I think they sent it by pony express :P I'm giving them the benefit of the doubt with the past holidays but seriously past two weeks to go from New Hampshire to Rhode Island?? I can walk there and pick up the paperwork faster ;)

Hi A,

I am really really trying, but it sure is getting hard to keep any semblance of patience. I shudder to think how long we would have been waiting had I not decided to make that call??? A majority of our thread have been approved and I am left eating "approved petition" dust. Hopefully for not too much longer though. At least the website updated with today's call which is more than some people are seeing. I just want to look in a few days and see an approval notice, that's all. I hope that is not too much to ask???? Thanks for the words of encouragement though. It helps to know someone cares.

I think calling with the RFE trick is what got me behind... I called so much that a rep one day told me if I called in again I would be put thru review..... well I got bold and told her it was my right... lo and behold I called again and poof.... in review I am....

My recommendation to all that follow... when you call get the persons name and ID number so that if that happens you have someone to fall back on

Latest I have been told is in 30 days I will be adjucated... so I guess I have to be good to get out of the penalty box

Congratulations to all the latest approvals. I am in Europe for 2 weeks so have limited access to VJ. I did have some time today to go thru the thread and update the table.

Divine Mercy, Sorry to hear about your 129F. I created a new black shading for you but i am also going to stay hopeful. Keep working your 130 but also try to not give up on the 129F in parallel. Keep harassing your congressmen and senators... What they are doing to your case is not fair!

Deb, Don't be depressed. I hope and i am sure your case will go thru shortly. Glad that you pinged the USCIS. Hopefully they would pay a bit more attention to it.

We are still waiting to for our case to get to the NVC. I have not called them yet as i am travelling and do not want to hold on the phone for 30 mins from Europe. I will wait and call them in a week when i get back.

I am sorry to hear that they put u on review. I haven't called but one other time and that was at the beginning of November and they told me it was not on an adjudicator's desk yet. I didn't say much cuz my 180 days was not up yet. Now I am two weeks past my 180 days, so now I have a right to ask. The lady who answered was very nice and very helpful and told me she would take it out of the file and place it on an adjudicator's desk immediately and I should hear about a decision in the next 30-60 days, hopefully not that long. This was only my second call. Now I will wait and see what happens.

We are still waiting to for our case to get to the NVC. I have not called them yet as i am travelling and do not want to hold on the phone for 30 mins from Europe. I will wait and call them in a week when i get back.

Please hang in there! So glad you called to see what the heck is going on. Remember, they told me my petitions were on the shelf on Nov 7th and they had never been touched and then lo & behold, approval came on Nov 15th. I expect you will see something from them soon.

I am glad also that I called or we would have still been waiting. However, you got a mean person to answer your call. This lady was very kind and helpful and asked questions of me instead of the other way around. She said she would pull our file and place it on an adjudicator's desk since it was out of processing time. So "wait and see". Isn't that what we are always doing???? :blink:

G&A, Thanks, I won't give up and I'll try with the senators but I really don't have any hope that it will do any good. The one senator's office's immigration guy is a total moron. He butchers the most straightforward requests, this will make his head explode. The other senator's office hasn't gotten back to me. I think I'm going to take a USCIS press release to him which shows what they did was not "policy". Maybe he can get them to answer for that. Last I talked to them my case was still "pending" but will be terminated once its off the shelf. Thank you for crossing out my I129F with black, I have been given the kiss of death after all. Have a great time on your trip!

I understand how you feel. It is sad watching everyone get approved while you are still pending. Now I will have the pleasure of watching everyone's spouses enter america while I'll still be waiting for an interview (Lagos CR1 interviews do take AT LEAST 10 months and the majority of them end up in AP which lasts another year or so, CR1 in Lagos is basically a death sentence). We might very likely be celebrating our 2 year anniversary before he comes in which case I'll get to see my son turn 3 before he lives with his father. Hang in there, at least you are still in the running for a K3. I know it's hard and frustrating, count your blessings. Having your husband's passport picture issue all messed up might have saved you from my fate, since they seem to focus on the fact that you filed the I129F after the fee increase. Maybe that would have saved me, who knows. They all seem to make up whatever they want.

I don't believe it will take them another 30-60 days to approve your petition. They are just giving you an over estimate to cover their own butts.

Thanks for your words of encouragement. I saw some of your posts but was at a loss of words as to what to say. My heart went out to you and I really didn't know what to say or do to help you feel better. All I could do was keep you in my prayers that things would work out somehow. I believe that God can make a way when there seems to be no way. We have to trust and believe in Him. After all, what God has brought together, let no man put asunder (that includes the USCIS). I really don't see how filing the I-129F before or after the increase helps or does not help anyone's situation. Why do they focus on that? That seemed to make the difference to her as to whether I was out of processing time or not. Why????? Maybe someone more knowledgeable and experienced could give me an explanation for that???? Would really like to know.

Maybe using James' shortcuts will help cut some time off of your wait for CR1 and pray over everything and maybe that will keep you out of AP or any more delays.
