I am still puzzled by the fact that my I-130 NOA2 indicates that my wife is in the United States... Where did that come from? Must be a template or something they use since the I-130 process was never meant to be used in conjunction with a K-3 non-immigrant visa when it was established.

Do all the folks who recently got their I-130 NOA2s in the mail have the same wording?

"The petition indicates that the person for whom you are petitioning is in the United States and will apply for adjustment of status. He or she should contact the local INS office to obtain Form I-485, Application for Permanent Residence. A copy of this notice should be submitted with the application.

If the person for whom you are petitioning decides to apply for a visa outside the United States based on this petition, the petitioner should file Form I-824, Application for Action on an Approved Application or Petition, with this office to request that we send the petition to the Department of State National Visa Center (NVC)."

Let me introduced myself. m from the philippines and my hubby is from washington. I just have few questions regarding k3. So frustrating that we sent the I-130 package may 8, 2007. My hubby called USCIS and was told they got it may 15. But when I checked online it says there On June 1, 2007 we received this I-130..... and the receipt date is July 11.we got the hardcopy of the receipt notice July 18. When will I start counting? Is it from June !st or from July 11?

Another thing, since We got the hardcopy of the receipt notice late, we file the I-129f july 18, and was receive by the USCIS July 24. it was transferred to laguna niguel aug 9, so does it mean I have to count from the date of the transfer aug.9 even USCIS receives it JUly 24? Plsss. help me. So confused. We are in the same boat and you guys are the one giving me hope.

pechez - For your I-130, the Priority Date is May 15. For your I-129F, there is no PD but they go by the receipt date which is July 24. (study my signature to learn more about all the different dates) The fact that you have more than a 2 months gap might mean that your applications might be processed separately as opposed to be paired. You should hear back soon considering your dates.

Deb, Hang in there. They will find your file and approve it right away. I am certain. you are i the same boat as (although some have had their 130 more recently approved and some have a bigger GAP between the 2 petitions.

Congrats for Wintime, kdancer04, My Lao Po! Great news.

PS I also never received an email from USCIS... i guess their IT support is on vacation.

That's right G&A, still in this stupid waiting game. I can't stand it anymore. Do you think USCIS will start approving July petitions in December? I'm I even close? I don't know what to think now.

Yes, it means your I-130 is being held for AOS.

Hi G&A! My letter has the same wording on it as yours about my spouse being in the US. If our spouses WERE in the US with us, would we even be on here talking about all of this????!!!??? You've got to love immigration, yanno?! Anyhow, just something else to let you know how intelligent they are . . . Our local office has those plastic signs that they have paid to have engraved, and they are supposed to be in Spanish. I cannot remember the direct quote for the sign, but the word "su" was supposed to be on the sign and they had the word, "sue". I thought I would wet my pants over that one . . . dang, no habla espanol? LOL Don't mind me . . . it's the nyquil talking tonight . . . I'm good though!

Wintime, congrats on the I130 approval

As Jonh&Celia said, don't worry too much about the online status for the I129F. John&Celia, G&A, and KingsleyPrincess had the same thing happen in the last 2 weeks. They had a touch on the I129F (but the status still said pending) and an approval of the I130 on the same day as the touch of the I129F. All 3 got 2 NOA2s in the mail, both were APPROVED! Hope yours will be the same.

What a day, few minutes ago 11:49pm I checked my online USCIS profile, and I saw an update on my I-130 date, it has been touched and the date is 11/21/2007, even though we are still on 11/20/2007, that's not the end of the story, I checked the status for my I-130, and there you go

My I-130 is approved

Here is the message....

[Current Status: Approval notice sent.

On November 20, 2007, we mailed you a notice that we have approved this I130 IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN. Please follow any instructions on the notice. If you move before you receive the notice, call customer service.]

But for my I-129F it still saying pending under process, but like I said above in my previous post the last update date says 11/20, that means my I-130 and I-129F were together, but only the I-130 got approved so far, I don't know what will happen to the I-129F, I hope it will follow, and I hope they will not say (because there is 2 months between both cases), ,

My Lao Po, since both were approved together, by the policy announced on Nov. 2006 here, only the I129F will be forwarded to NVC. Your I130 will be held for eventual AOS unless you file I824 to get it moving, which will cost $$ and take too long to be worthwhile. You are pretty much locked into the K3. Davejaz was "lucky" in that his petitions were not paired, and his I130 approval came so early that he chose to pursue it instead of wait for I129F.

Wow almost back to back on the NOA2 for both I-130 and I-129 huh, G&A?! Congrats!

Info for those of you in the same time frame/path.......

I have been away in China with my wife all this month and will return to the US on the 30th.

I just checked in with the CSC and found that my I-129F for K-3/4 and the I-130 for CR-1/2 have both been approved on the same day, November 6th at the CSC.

Still no word on if transfered to the NVC yet, although I assume they each have been sent on by now ??

If the I-130 moves fast, I imagine I should pay the extra bucks and pay the due bill, and move with the CR-1/2 due to the increased benefit upon entering the US ??

I will not be able to phone the NVC until I return to the US after the 30th, to check my status and get my GUZ (Guangzhou Consulate) number.

I waited about 145 days from I-129F NOA-1 until the NOA-2 and longer, of course for the I-130 NOA-2.

Sunny and very warm in Southern China !!!!

Yes, you are correct in your assessment !! I thought about this after I made the post yesterday.....it is too long a wait for that I-130 to process fully, as well as the extra $$$$$ !!! I am just hopeful that the rest of the process (P-3 and P-4) go more quickly than that NOA-1 to NOA-2 took, for those of us who filed in that May June and beyond, period !!??

BTW, do you happen to know, off the top of your head, how soon after arrival at the POE in the US, I can file the Form I-485 Application for AOS, for both my spouse and step-child ??

Thanks much for the reply !!! ;)

As soon as they arrive, you can file for AOS.

Thanks much for the reply !!! ;)

I was beginning to think they lost my papers or something.... THis is soo exciting!!!! Thanks everyone for helping me through this process!

Kristi

congratulation!

I have a question, did you get first an email or did you see your approval notice online?

I asked you because I normaly don't check my case online. I check my email every one hour.

I sent my I-130 one day after you (on 12. June ), but I haven't got any answer from USCIS. :(

good luck

I signed up for the automatic email advisory program, but I've never received an email from USCIS to this date, even though they approved the petitions in early November. I suggest you either log on to the site or wait for the hard copies in the mail....CSC isn't doing that good of a job lately with their IT staff apparently....

John and Celia is right checking the online status is better idea then checking your email, because the email notification for any update on the status seems to be not working at all,

your other choices are either to call the 800 number and they can read your case status for you or wait for the hard copy by the mail.

if you have any question about the online status tool let us know, and I hope your case get approved very soon.

Qasim--Aisha

Thank you, I hope those recent touches be approvals for both of your cases.
