fiance left me after K1 petition approval

Hi, 

This is not the topic i want to be talking about openly but i need some guidance if possible. 

I am an Australian male, i went through the K1 Visa with my American fiance, so i could live in America with her and our 2 year old son. 

The Visa process took 15 months before it was approved, i was about to go for my final interview when my fiance decided she did not want to go through with it (she is the beneficiary so i believe she has to withdraw the petition?) 

Now i want to be close to my son in America as the distance between us is killing me, is there anyway this is possible? are my only chances a visa lottery?

That’s tough that you were so close to the end of the process. Yes, she is able to withdraw at any stage. I understand you want to be with your son but an unhappy marriage is awful. I was in one for several years. 

 

You may be eligible for the diversity visa (visa lottery) although our current president has made no secret of his desire to end that program. 

 

Another alternative could be a work transfer if you work for a company with offices in the US (L-1 visa). 

 

You can still visit your son. I know it’s not the same but it’s better than nothing.

 

Your son can petition for you when he reaches 21, assuming he still lives in the US then.

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!
