SSN and AOS

Hi,

I came to US on K-1 visa, and I got married to my Fiance. I have received my Marriage certificate. Now I am filling Social security forms and AOS forms. In those forms it says Last name, which last name should I use?. Maiden(before I got married) or my husband's?

Secondly, in AOS it asks when will your visa expire? Is that date, the date Visa is expiring or is that the date 90 days after I have entered US?

You put the name you want to use on the forms... so if you are going to be using your husbands name now you are married then it would be your married name.....

The date you put is the expiry date of your K1....

Hey Muni - be aware that they may or may not give you a SSN card because many of use have had problems getting the SSN card after getting married or in getting the name changed - many of the SS offices demand an EAD or Green card before they will change the name on an existing card or issue a new one (for those that didn't get a card prior to getting married.) But you can try and see what happens - Good Luck

As others have said apply with the name you intend to use. However, unless your marriage certificate has your age or date of birth, you are going to need another acceptable identity document in your married name, if that's the name you want on the card. If it doesn't you can still apply with your maiden name and correct the record after you receive your EAD card or I-551 with your married name.

a. Bride Takes Groom’s Last Name

In all 50 U.S. States (this means the 50 States, Washington, D.C., Puerto Rico, U.S. Virgin Islands, Guam, Northern Mariana Islands, and American Samoa) the bride may take her husband's last name (surname or family name) as her new last name. (EXAMPLE: Jane Doe married John Jones and she may change her name to Jane Jones.)

Interim Guidance: If the bride wants to take her husband’s last name, accept the marriage document as a legal name change for the bride if the new name can be derived from the marriage document; even if the marriage document only shows each partner’s first names, the bride’s prior surname and husband’s surname. The marriage document alone can be accepted as evidence of identity for both the old and new names when it meets the criteria described in RM 00203.200G.2.

2. Determine if the ID Document Has Required Information

Ask the applicant to submit one or more documents that show the person’s name AND provide:

Biographical information in addition to the person’s name that the reviewer can compare with the data on the SS-5 (e.g., date of birth, age, or parents' names) and/or

Physical information that the reviewer can compare with the applicant (e.g., physical description, photograph).

NOTE: A non-picture identity document must have the person's name as well as information that can be compared to the Numident, the applicant or other documents submitted (e.g., age, date of birth, or parents' names).

When issuing immigration documents, the Department of State and DHS issue them in the person’s legal name. The legal name is also generally the name in which the foreign passport was issued.

When an alien applies for an SSN card, we presume the name on the immigration document is the legal name unless the applicant presents evidence of a legal name change (e.g., marriage) that occurred after the immigration document was issued.

This is in addition to proof of current lawful employment authorized status.

We spent another hour at the SS office yesterday trying to get the name changed. The office here was no help at all.

We are trying to get a DL for Lucero. The DMV will not give her a DL until there is a name change at the SS. The DMV told us to talk to the SS and the SS told us to talk to the DMV and get a liscense in the maiden name.

This all really sucks. Lucero has been here since July. We filed for AOS and EADS Nov1. Other than a quicky RFE that we asnwered quickly we have gotten nothing. No bio, no EAD, No appointment, nothing.

7 months now. Can't work, and can't drive. I just don't understand how they could do this to anybody.

Hopefully this guest worker program will pass. If so I think we will send Lucero to Mexico and let her come in illegally so that she can get a work authorization.
