J1 visa waiver

Timeline

Hi everyone! I am currently living in the states with my baby and husband. I came here 2 years ago as a j1 student and I never returned home ( Jamaica). I am subjected to the 2 year home residency rule and I am needing assistance to tell me some of the reasons why the government in my home country will not grant me the waiver. I took student loan back home and I am almost finish paying it and I am not sure if that will be a reason for the government to not grant me the waiver. 

Thank you and I would like to hear everyone’s input.

Did you receive any US government funding?  If so, a waiver is almost impossible to get from what I have read.

Senior Master Sergeant, US Air Force- Retired (after 20+ years)- Missile Systems Maintenance & Titan 2 ICBM Launch Crew Duty (200+ Alert tours)

Registered Nurse- Retired- I practiced in the areas of Labor & Delivery, Home Health, Adolescent Psych, & Adult Psych.

IT Professional- Retired- Web Site Design, Hardware Maintenance, Compound Pharmacy Software Trainer, On-site go live support, Database Manager, App Designer.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

My j1 visa expired 2016 and my husband and baby were born in the states. As it relates to funding, I used my own money and husband money to come on the  j1 program and the government only paid my tuition fee when I was going to college

So what is your current status? Are you in overstay and wanting a waiver so you can AOS?

From what I have read, the combination of J-1 and student might be a factor.......but I'm just speculating.....

Um, wow ok.

And you’ve been in overstay since? Have you applied for AOS already or still waiting to start the process?

I presume you have seen the Jamaican embassy procedure for obtaining certificate of no objection?

They paid your tuition so they don't freely give waivers in those cases. The whole point of funding you was so you could return home and contribute to that society. But you seem to also have overstayed your visa which is another issue on top of that. 

Cateogory: CR1

  • NOA1/Notice of receipt: Sept. 15, 2015
  • NOA2/I130 Approved: February 8, 2016 (NO RFE) :)
  • Process slowed down by us
  • Sent documents to NVC: April 11, 2016
  • Scan date: April 14/ May 7th (NVC said both I dont know why)
  • Case Complete: May 31, 2016 (No checklist) :dancing:

August 17, 2016: Visa Approved!!!! :dancing:
