Husband's W-2 shows him as married when he wasn't...

Hello all...

Sooo... I'm here, we're married, and we're just about ready to send off all the AOS stuff. I've just spotted something though, and am wondering if it might be a problem. My now-husband's employers still had him on their payroll system as married until recently, even though he got divorced five years ago. He never looks at his paystubs or anything, so didn't realise this until he printed a load of them out for me to take to my K-1 interview, and I noticed it said 'married' - his payroll dept. have since corrected it on the system (and have told him it makes no difference to anything), but his 2006 W-2 that we're going to send with the I-864 clearly says 'Taxable Marital Status: Married' on it. Of course, he is married now, but only as of last week!

Will this be a problem? Should we send some kind of explanation, or would that be more likely to invite trouble than avoid it? I was worried that it might be questioned at my visa interview if the CO spotted 'married' on his paystubs, and had a copy of an email exchange between him and his payroll dept. sorting out the error, in case they asked... but in the end, they didn't even look at the paystubs, let alone ask about it! If they had, though, at least I would have been able to explain on the spot... something I obviously can't do with AOS paperwork that we're sending to USCIS! So... to send an explanation, or to ignore it? I don't know, maybe this kind of thing is quite usual and I am (as ever) finding something to worry about unnecessarily - but I would like to avoid an RFE if possible!! So any thoughts would be appreciated... :)

Hey you!! The wedding was lovely (thank you!), considering there was just the two of us, the judge, and the clerk present - all a bit of a blur but I couldn't stop grinning anyway! :)

And Cincy is good... finding my way around & getting used to the place.... oh, and I managed to get my SSN in the end - went in on day 14 after my arrival, and had no problems that time - it got here within the week! How're you, and how's life in CA??

Ugh, hope this won't be a problem... had totally forgotten about that 'married' glitch 'til I glanced down at the W-2 and there it was... sigh. :unsure:

I'm sorry I do not know the answer but it seems it could be a problem.

W2's do not show marital status. Just detach the W2 from the other paperwork just like you would to attach to your tax return.

Oh wait... am I looking at the wrong bit here? Being the non-USC here, I'd never seen a W-2 in my life until yesterday, so am likely to be being a bit dense.... there's a 'W-2 and earnings summary' at the top which has the taxable marital status on it, but it's not mentioned anywhere else.... I've only just noticed that there's four different detachable perforated bits which appear to be identical - so these are all W-2s, then - and it's just a copy of one of those that needs to be sent?! (And in case you're wondering while they're all still attached together, it's because he hasn't filed the tax return yet... that's being sent off tomorrow, and a copy of it is being sent with our AOS, along with the transcripts from 2005 and 2004... I'm hoping that'll be okay). I hadn't realised the whole thing wasn't just one form - aha, thank you, looks like I might be worrying about nothing if we just need to send a copy of one of the little forms, rather than the whole sheet! :)

Aha, thank you for reminding me - that is actually the one thing I don't yet have photocopied, and sending the originals with the I-864 might confuse USCIS a touch! Will be soooo glad to get all this stuff (tax return and all) sent off so we can, hopefully, forget about forms and paperwork for a bit! (Not to mention the relief on both sides to finally not have the words 'tax' and 'return' cropping up in conversation every day.... :whistle: ).

Make sure he keeps the originals so he can file his (late) taxes. ;)

It'll be the 2006 one, and we're sending the 2005 and 2004 transcripts as well.... I'm guessing we'll get RFE'd for some kind of proof that the 2006 one has actually been filed (he's filled it in but not sent it yet - it's going in the mail today or tomorrow... and he's going to attach a copy of the completed form with the I-864)... this is after me going 'noooooo, we need to send the most recent one, and if the 2006 one should have been filed, I think we need to send that, so file it noooow!!' - obviously being A Foreigner I have not the faintest clue about tax returns, but C. reckons that if the forms say 'a copy of your tax return', he can send a copy of that (ie a photocopy of the filled-in form) - it's just that the tax return in question will be being filed right at the same time as the AOS. Or would we be better off filing the tax return and waiting to file AOS until... what? Until we have a transcript or something we can send? Ugh, I'm so clueless about this (tax-related) stuff! :unsure:

Hmm, I am now going to look at a map and work out where Montgomery is - despite recognising the names of most of the local areas, I still have no clue where most of them actually are! :blush:

I'm guessing you'll get an RFE, since he hasn't filed yet. But who knows, I'd send it in now!

featherB- Montgomery is north on I-71 at Ronald Reagan Highway. It's close to Kenwood Mall- if you haven't been to that mall you MUST go! The shopping is way better than Fountain Square!

I can only suggest that you send in a letter accompanying the W-2s explaining the problem and maybe a copy of the divorce decree to prove he was divorced. Confirm that his employers were informed about it, but didn't actually change anything until recently.

It might save you getting any additional complications. Better to be over prepared!

and Trader Joe's s RIGHT THERE in Kenwood too! :thumbs: ooh, and a Fersh Market which has the best (irish) sausages in Cincy.

Fountain Sq isn't even a mall. It sucks, it used to be good before downtown was abandoned for the 'burbs.
