Work Visa Past Due Date

So my husband and i filled for adjustment of status since he is already here in the states. USCIS received our applications on Aug. 6th we called on Tuesday to check on the status but was told that they were now working on cases submitted on Aug.13th which means its past the normal filing time. So now my husband and I are extremely worried because we are not sure why we never got his work permit yet being that every time we had called to check the status we were told that it would be approved between 4-6 months. So we were wondering if anyone has any idea what might be going on with our case and if we need a lawyer or maybe it to early to involve a lawyer yet?  Please help! Our application is at the the National benefit Visa Center. They said that it will take about 30 days to get back to us. We just wanted to know why its taking longer to get his work permit and travel documents as well. We filed for I-130/I-485/I-765/I-131.

You are going to have to be a bit more patient. . . 

 

Just because they are working on cases a week after yours does not mean they are done processing the cases the prior to yours.   Background checks get done when they are done.  It all depends on how you filed and where you are from.  Cases that are adjusting from another visa like F1 and B1/B2 are still subject to the checks that those that filed while the spouse was overseas. 

 

Since your spouse is from Nigeria I would expect those checks to take longer.

 

Did you also file the I-130a and I-864?

August 2, 2018 Case Complete At Consulate

September 25, 2018 Interview in CDJ and Approved!

October 7, 2018 In the USA

October 27, 2018 Green Card received 

October 29, 2018 Applied for Social Security Card - November 5, 2018 Social Security Card received

November 6th, 2018 State ID Card Received, Applied for Global Entry - Feb 8,2019 Approved.

July 14, 2020 Removal of Conditions submitted by mail  July 12, 2021 Biometrics Completed

August 6, 2021 N-400 submitted by mail

September 7, 2021 I-751 Interview, Sept 8 Approved and Card Being Produced

October 21, 2021 N-400 Biometrics Completed  

November 30,2021  Interview, Approval and Oath

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well

Yes I did as well! Forgot to mention it! My husband said most of his friends that filled the same time with us already got their within four months of filing so he is so worried and I keep telling him to be patient but he feels like something is up.
