Just checked the case tracker app for VSC and noticed a pattern. I checked 500 cases near mine and the cases who fingerprints were done in Feb 2019 have been approved. I assume that since our fingerprints were done in March, we should start seeing approvals in March.

 

Or maybe I'm being too optimistic. But there is definitely a pattern. Check out the case tracker and you'll see.

Not necessarily. I also noticed on the case tracker that many cases after mine (bio march 2019) have been approved already and they were not transferred. On friday they approved 5 people after me. It's frustrating because they're supposed to go in the order they receive cases, instead it's lottery-like. Who gets pulled from the shelf gets approved. I would have never thought that dealing with the USCIS would be such a nightmare.

Thanks for the info.  Were all these cases CR-1/IR-1 or were previously interviewed by USCIS or a mix?

I-130 (for parents of US Citizens):

 

8/19/2022: NOA (IOE0917XXXXXX); Texas Service Center

7/22/2023: Both (parents) petitions approved

7/27/2023: Both cases sent to NVC

8/8/2023: Received NVC welcome email for both parents

Sorry, scratch what I said up there. The case tracker shows the "last updated" date - not the final date. My analysis means nothing.

  • February 13, 2019 - Package delivered to Dallas Tx;
  • February 15, 2019 - Credit Card Charged;
  • February 19, 2019 - Electronic Notification Rec'd, Case Location LIN - Nebraska;
  • February 21, 2019 - Received NOA with 18 month extension for wife ONLY, not 14yo dependent who is on application;
  • March 12, 2019      - Notified USCIS that we never rcvd i797 for 14 yo minor, they provided a case # and submitted a Svc Request
  • May 2.2019             -  No forward motion, we called again and despite there was an officer assigned to this service request nothing happened/ no extension. We filed an InfoPass and have an appointment for Monday 6th for passport stamp.
  • May 6, 2019 - Attended InfoPass appointment in Philadelphia local USCIS local office for 930. This was for a never rcvd 797 for our 14yo dependent. Arrived 9:15, not crowded at all. No extra photos or fingerprint taken. We were in the car (lots of parking available) at 945. Pleasant female officer, she updated and checked for no changes. Stamped passport, explained is valid for 1 year. The took the green card which expired 5/4/19. No issues or problems.. I asked about the non receipt and she said it's pretty common.. 
  • August 23 - Biometrics NOA, scheduled for 9/3 @1pm
  • September 3 - Biometrics
  • September 4 -Fingerprint Review was completed
  • January 8 - ROC, Card Being Processed, Citizenship is next!
  • January 15 2020  - Cards Delivered

What is your timeline, you don't have anything posted...

IMHO you are throwing money away to how an attorney at this point. They Can't really do anything when you are still within you processing times.

If suing USCIS was fruitful, a lot of people would have done it. Even if you or the person involved has money, you still will be losing your precious time with attorney and USCIS. You can only sue USCIS for delays if they have not processed your case after your case is out of normal processing time, which for VSC is 17.5 month and probably will be greater in the future. Even then you should request a case inquiry from USCIS, then go through your local representative or sue USCIS. It is frustrating. For me personally the most frustrating things are how they claim that they generally process the cases in the order they receive them yet they play lottery to make their processing time more "eye-pleasing". And of course their outrageously long processing times for certain metro areas. There is no oversight on this agency, hence they show no accountability. I had a colleague who applied for H1B visa 6-7 years ago. Our employer sponsored it. After many months of silence they sent an inquiry to USCIS. USCIS claimed that they never received the case, yet they successfully cashed the check. Then they admitted that they cashed the check but lost the case. Our employer sponsored new application, applicant's position was terminated, he had to go back to his country and wait for the new application to be approved. USCIS never returned the fee from the first application. I'm sure if our employer involved their lawyers USCIS would have returned the fee, but they did nor return it voluntarily. It's small money no employer is going to involve their lawyers for it.

Case Was Approved

On February 24, 2020, we approved your Form I-751, Petition to Remove Conditions on Residence, Receipt Number EAC19........ We will mail your approval notice. Please follow the instructions in the notice. If you move, go to www.uscis.gov/addresschange to give us your new mailing address.

 

My car was received by the USCIS on Feb 2nd 2019, no single update or anything till it was approved. I did finger print like two months after the case was received. Hope everyone get theirs too. Good luck guys. Biafra or nothing.

Anyone in this group who has not been approved yet, I did some analysis. I tracked the cases on the case tracker and put them on the spreadsheet. My case is in VSC. VSC’s timeline is 13.5-18.5-months.

For cases around 13-13.5 months wait time- VSC completed the 50% of the cases by 13.5 months. If you are lucky to be in that 50% pool than you already got approved. 25% of the cases got RFE, some cases got transferred. After VSC reached its 50% completion goal, it slowed down the approval process. Because now VSC has 5 months to complete just 43% of the cases. So, they leave the cases hanging (especially the ones that are in fingerprints received status) and will start actively working on late February/March cases to finish their 50% completion quota by 13.5 months. RFEs will be approved after certain number of days when VSC receives them. This is why cases from October-December 2018 are still pending while the February-March 2019 cases are getting approved. USCIS has target deadlines that it has to meet, they do not care about the extra wait time they are imposing on applicants

 

The Approval/RFE ratio is about 2:1. This seems to be quite consistent.

 

Here are the numbers for early February cases (500 cases on case tracker) range 5527-6027.

Total                -66

Approved       -26

RFE                  -13

Transferred     -3

Pending (Fingerprints received)  -22

So, my conclusion is that if you are not in that lucky 50%, then you have a better chance of getting approved if you got RFE than if you are in that “Fingerprints received” pool. Remember that by 18.5 months VSC  just has to complete 93% of the cases by their own admission, meaning that 7% of the cases will be outside normal processing time. So, don’t be afraid of getting an RFE!
