I thought you need to get your 10 year green card then apply for citizenship 😐

Your Lawyer is correct, when you file for I751, you get an 18 month extension letter, so you have a valid Green Card when applying for citizenship.

They approve both at the same time, but the I-751 first, so you technically got your 10 year GC for a few seconds before switching to citizenship.

A cashiers check is also valid if you don't have a checkbook :)

even lawyers can make mistakes.. Go to this link , look at the Citizenship requirements ( in a box). Page 22. https://www.uscis.gov/sites/default/files/files/article/chapter4.pdf

 

"You may file Form N-400 ninety (90) calendar days before you complete your permanent residence requirement if your eligibility for naturalization is based upon being a: • Permanent resident for at least 5 years; or • Permanent resident for at least 3 years if you are married to a U.S. citizen". 

 

So yes applying for Citizenship will speed up the 10 yr green card/ removal of condition process.

yes i have one but i did not have enough money in it at that time so i chose to pay by credit card. can't wait to send it back tomorrow. Ughhh i am so mad at myself. And my credit card expires on March 9th. Plus i am trying to apply to jobs and i have interviews i can't tell them my CC expires soon :s

I hope i am doing the right thing by filing a new form I-751, and not using the last one.I hope they do not expect me to send the old one with just a new check... because online the status does not say RFE it just say that they received my file and they do not need anything from me.

Sorry to hear that your application was rejected. @Christiannic might have some suggestions as their application was rejcted since they sent it before the ROC window and they had to resend it.

they will know that anyway when is the expiry date of CC.  But what's done is done, make a check  and send it along with the petition. Good Luck !

The below list should help 

 

1. New I-751 form duly filled.

2. Cover letter mentioning why the I-751 was sent back by USCIS due to CC issue. 

3. Mention how the issue is now rectified by paying with a Check instead of CC.

4. Keep all the same supporting documents, if need be add something more if you want.

 

This should help. There won't be any RFE because they aren't requesting for any evidence, this is a case of rejection of CC pure and simple. Don't fret over it.. Just do it correctly this time.

Sorry to hear this! But like others said good to use a check. And you can include the electronic notification form so you know when they receive it.  Good luck!

Yes, you only send the petition AFTER you receive a notice from USCIS stating that you're now in the ROC window. Thats what I did. I received a notice from USCIS informing me about the 90 day window for ROC. Sent the duly filled form and supporting documents 2 weeks after.
