Affidavite of support question

Hi,

We are getting married in 3 weeks here in the states. I have been checking the AOS requirements and just have a question regarding affidavite of support.

If you can show that we have assets worth $375k on top of my gf's income for her job. She started on tuesday as we arrived from ireland 2 weeks ago.

Should the above be enough to show that i wont be a burden to to the united states.

Yes. Check out the Poverty guidelines and when sponsoring based on assets you need to provide 5 times the annual level (this is generally accepted). Good Luck

Just a word of caution.

We got an RFE for the I864 and we also had way way more than the required 5 x times over in assets. They asked for a copy of this years tax return to prove income was still above the poverty level - they took no notice of our assets!! I even called and argued it with them, but they insisted on the proof of income.

Our income was also only below the level due to a large depreciation in my self-employed partners taxes last year. We got this years today and we are way over, so will be fine.

Sometimes it seems they ignore their own guidelines! Good Luck

I think it also depends on how 'liquid' your assets are. If you have cds, money market accounts etc. - you are very liquid - stocks and bonds/Real Estate/mutual funds are not so liquid. Good Luck
