Hi Guys

I have a few questions regarding the Domicile Issues..

Me and my wife got married in the UK.. She is USC and I am UKC. We have started the I-130 petition process, which it has been sent to Vermont.

We are both Working in the UK at the moment and my wife has a spouse visa with LLR. How can we prove her primary address is in the US? She still has a US address so I am thinking..

1. Address on Petition is US address

1. Since she has LLR surely this shows that her status in the UK is temporary (although she is working)

2. She has obtained a new US bank account and cell phone (for bills, ties.. )

3. She will be included in our Co-sponsors household for the I-864

Any other suggestions or help appreciated..

Find a job in the United States - Will be actively searching

Locate a place to live in the United States - We have a place to live

Register children in U.S. schools - No Kids

Make arrangements to give up (relinquish) residence abroad - Will hand in notice

Other evidence of a U.S. residence - US Bank Account, Cell Phone, Car agreement all in Wifes name

Do you think this will be suffient ?

The only part of your process that requires your wife to be domiciled in the US is for the completion of the I-864. Even then, there is no explicit documentation that needs to be provided to prove domicile when you submit the package to the NVC.

The decision making will be done during the interview at the London Embassy. The same London Embassy that refused your application for DCF on the grounds that your wife's Principal Residence must be in the US.

Remember, I went through the same route as you and we had no problems with respect to domicile.

In any case, the fact that you have some documentation such as bank statements and bills only strengthens your already sound situation, in my opinion.
