F4 visa aging out issue (merged threads)

Yes.I paid on Thursday and it's Monday evening, still "In process"

I was born on the 27th of April, 1995. Our priority date is April 2006. Our pd is expected to become current in January 2020. By the time our pd becomes current, my cspa age will be over 21. I talked to an attorney who asked me to ask my aunt (petitioner) to hire an attorney in the US but I have no idea how hiring  an attorney will help my case. Help.

You can look online for reputable immigration attornies. Also, at the top of this page, there is a tab named "Ask a Pro". It will take you to a link to chat with a lawyer.

 

But be advised. A lawyer will not magically get you a visa or speed up the process or extend your CSPA. If you have aged out pass your CSPA, then you have aged out. USCIS already allowed an option for you to be included, they will not keep moving the goal line. 

 

You are considered an adult in the eyes of immigration, therefore you would need to find your own way to the US.

Yeah that's exactly what I was wondering. No one can magically speed up the case. I don't understand how an attorney could help me with it.

Expected by who? Nobody can predict this with any certainty. 

 

You are correct that hiring a lawyer won’t do any good if you’ve aged out.

That's true. You can't predict it BUT, the pd goes up in a sequence and if it keeps going at the same pace, it'll probably become current in January 2020

Yes but it doesn’t go at a steady pace, that’s why you can’t predict it. Anyway, it’s pretty much out of your hands now... you just have to hope it happens earlier than you think. Good luck.

F4 goes at the most unsteady pace of any preference category. It has advanced 2+ years in under a year, followed by regressing several months the following year.

There's an average (which still varies heavily depending on when you choose to start it), but that's just to get a ballpark for cases still a ways out.

hi guys i just had a question regarding my son who is a derivative beneficiary of f4 visa. The nvc welcome instructing me to login to my account came a few weeks ago and to my surprise my sons name, who is 25 years of age, is mentioned with the option to pay his fees (325). I wanted to know whether this meant he would be immigrating with me? If not then why are they asking for his fees and application submission? Should i give his fees even if he has clearly aged out?

Aging out does not depend on your chronological age. Your son could be 27 and still eligible to emigrate if his cspa is under 21. 

 

What you could do, is calculate his cspa age. 

 

How long did it take for your visa to be approved
