"The Philippines has a high H-2B overstay rate. In FY 2017, DHS estimated that nearly 40 percent of H-2B visa holders from the Philippines overstayed their period of authorized stay. Additionally, among all U.S. posts throughout the world, U.S. Embassy Manila issues the greatest number of T-derivative visas (T-2, T-3, T-4, T-5, T-6), which are reserved for certain family members of principal T-1 nonimmigrants (certain victims of a severe form of trafficking in persons). This really doesn't surprise me at all since I currently know someone who has overstayed her H2B visa and is working Illegally right now.

Along the line of PI visas, do they still get expedited automatically (family visas)?

Yup. I have a friend in a similar situation. Came here in 2004 on an H2B visa. He's still around. He managed to get an SSN and is working at a fast-food restaurant.

Well of course they have a SSN because they have to use the SSN in order to pay the taxes. But this person I know is a family member and we are worried that she might want to stay with us.

I know but my point is that unlike your wife's niece, my friend is working "legally" but in the US illegally.

Needs to have work authorisation to work legally.

He probably is using someone else's SSN. So it looks good on the surface but once they dig into it then the cracks will start to show.

Yeah, seems really shady. Don't know what or how he did it. All I know is that he's worked at this place since he got here.

He's also Filipino. If there's anyone who knows their way around a system (even if it's illegal), it's gotta be Filipinos.

That statement right there is the truth...
