Hello all. My mom, Green card holder would like to petition my siblings who are over 21 years of age 

What forms do we have to submit?

Is it best for her , being a green card holder to petition them or would it be best if it would be me , the us citizen?

Yes, your mom can petition for your siblings. However, your siblings must stay single. The first step is file for I-130.

-If you mom, it took around 7-8 years.

-If you, it took around 14-15 years.

So, your mom file a petition is the best choice.

Since this is this Philippines according to your VJ account, it would actually take your mom 12-13 years according to the USCIS calendar. It would take 7-8 years for other countries excluding China, India, and Mexico.

 

For you to sponsor your siblings, it'd take 14-15 years.

A beneficiary can have multiple petitions.

 

Your LPR mom can file for unmarried children ONLY.  They can not get marry.  They must stay single until they get green cards.  The current wait is about 12 years for the PI.

 

You can file for siblings.  They can get marry.  Their spouses can get green cards when they immigrate.  Currently, this takes about 24 years.

 

The real wait time will be different.  There is no way to predict how long the wait will be.

Yup, I’d suggest filing both. Quicker if mom gets them first, but a F4 petition stays alive if sibling decides to get married in the interim. Of course if mom becomes a USC in the interim then they can get married too and still keep the petition alive. Many ways to slice this onion, but none of them quick.

If they get marry after mom becomes a USC, they would change from the F2b category to the F3 category it would be 23 years.  It would be best not to marry and come under the F2b category, go back and marry, then petition for their spouses.  

 

The reason we come to America is for our kids.  It's quicker for the children to come under the F2b category when they are young.  They may age out under the F3 category.  

 

Marriage would be a BIG MISTAKE.

Well, of course it’s up to each individual to decide whether getting married or moving to the US take priority. 

 

This could all be a a moot point anyway as all of these categories fall under the chain migration ones that may not be around anymore in 5 or 10 or 15 years.

4/25/2016 : Received NOA I-797C Priority Date : April 18, 2016 [Day 5 I-130]

5/6/2016 : Visit Doctor for TB Test, X-Ray, Blood Works & Fill in I-693

5/9/2016 : Visit Doctor again to check result, X-Ray & Blood work all passed but reacted to TB Skin Test (Doctor said it is normal as many ppl had BCG before...not sure why.) :huh2:

5/10/2016 : Doctor sent form to TB Clinic for TB Clearance :clock::clock::clock:

5/18/2016 : Still no words from Doctor, decided to send I-485 to Chicago Lockbox first

5/19/2016 : I-485 package picked up and sent [Day 29 I-130]

5/24/2016 : I-485 package delivered and received by USCIS [Day 34 I-130] [Day 1 I-485]

5/27/2016 : Received 3 texts and emails from USCIS assigned MSC Receipt Number [Day 37 I-130] [Day 4 I-485]
