My wife entered the USA last month on a K-1 visa and we got married a few weeks ago in Las Vegas (I-485 AOS has not been submitted yet).

Today, I took my wife to the Michigan DMV (Secretary of State) to get her a State I.D...... They issued the State I.D. using my last name (married name) but they said they couldn't use her Ukrainian middle name "Volodymyrivna" on the State I.D. because it wasn't listed anywhere on her Ukrainian passport or K-1 Visa/I-94 form. So instead they used her Maiden last name as her Michigan middle name. They claim this is common procedure so I said ok. Next we went to the Social Security office and got a Social Security card for her. The social security card matches the State I.D. name (i.e. using my married last name and her maiden name as the middle name.) Question is, when I submit the I-485 AOS application, should I use the name that was issued at the State I.D. and Social Security card ? If so, will they give us a hassle about it because the marriage license, ukrainian passport, etc.. all shows Volodymyrivna as her middle name ? Should we just include a copy of the state i.d. and social security card along with the marriage license and supporting documentation to show that is the name we want on the Green Card ?

Does the Passport show her middle name or not.... how about her birth certificate??

I would use what is her legal birth name shown on these vital records. The others you don't need to copy and include in your AOS application. I might also venture to guess that if that's what she wants her name to be now it is possible that she would just record her maiden name in full in other names used sections on forms....

May 31, 2012... Express Mailed N-400 application to the Nebraska Service Center for military spouses filing overseas

Jun 11, 2012... NOA date and Cheque cashed Day 11

Jun 28, 2012... Placed in line for interview scheduling Day 28

Jul 20, 2012... Email from USCIS London for info to schedule interview Day 50

Sep 1, 2012... Moved back to the USA

Sep 12, 2012... Email from USCIS London scheduled for interview/oath Sept 28th in the UK(will be day 120)

Nov 26, 2012... Had submitted change of addresses. Notification that I have again been scheduled for interview Day 179

Dec 1, 2012... Letter arrived Day 184 with new interview date Jan 4, 2013 (Will be day 218)

Her Ukrainian passport only shows her first and last name (no middle name).. Your right though, her Ukrainian Birth Certificate does show her middle name, but I forgot about that at the time we were getting the Michigan State I.D. and social security card. I agree with you, so on the I-485 application I will use her Birth given Middle name, and once we receive the green card, we'll go back to the Michigan DMV and Social Security to have them update the middle name to her original birth (instead of using her maiden last name as her middle name). I will bring the Birth certificate too just in case they give us any problems.. This seems like the best way to go.. ??

If your wife really wants to retain her given middle name rather than replace it with her maiden surname then that's what she should put on her I-485. And recognize that she now has more 'other names used' to report.

What's on her birth certificate, by the way? [EDIT: never mind, I see your subsequent post. Get ready to do battle with the SSA and state DMV]

This is a patronym, it's not a middle name. Why would she want to use it at all? It's her business, of course, but I don't understand why someone would want to have a patronym-looking middle name.

When you file AOS, you just need to be consistent and use the same combination of names everywhere. It should match the SS card and DL.

Yes, I see your point, but we already submitted the AOS today using her Birth middle name "Volodymyrivna". So it will not match the SS Card and DL. So if the Social Security Office and Michigan DMV are difficult to change the middle name to "Volodymyrivna", then maybe it would be easier to change the green card to match the SS Card and DL once we receive the GC.. It doesn't matter to her, either way, we were just thinking it makes sense that everything should match her Ukrainian Birth Certificate and Passport...

So, we returned to the DMV and Social Security Office with her Birth Certificate, Marriage License, Passport (which wasn't any help because her middle name isn't listed on that), and the Social Security Office was pretty cool about changing the card to show her given middle name, the DMV was resistant to change it but after a few minutes of conversation, they agreed to change it. So now everything matches, and it should be ok.
