I-864 - Joint Sponsor Married Filing Separately

Hello everyone,

 

My Joint Sponsor is married and files taxes separately from his wife.


How to fill I-864 part 5 (Sponsor's Household Size)? Are we supposed to include his wife (question 3)? Or the beneficiary only?

 

Does she need to fill an I-864A form?

Your joint sponsor is married, so his wife is counted, as would all his other dependents be counted, if any.

Got it! Household Size = 3

 

Joint sponsor's income is above the minimum requirement and we're only reporting his own income on I-864. So, we left items 8; 9 and 10 as the print screen below.

 

In this scenario, his wife still required to fill I-864A?

Not specifically required, but a Consular Officer can choose to require it.  They are married.  The obligation under the contract is going to be a joint one anyway, unless they divorce, and maybe even then.  In my opinion, it is best to both include her income, AND have her provide an I-864a.  BUT, you MIGHT get away without it.  Your risk.

Did you have to file an I-864a for his wife in the end please? I am in the same position as you were!

Yes, I filed. I think it was not explicitly required but ended up filing that form just in case. I would recommend doing the same.
