My fiance and I have read through all 31 pages of this thread. We both want to say THANK YOU for everything. We just got our NOA2 last week, so we are preparing everything we will need for the P3. I'm sure we will post a few questions, but you have already answered so many questions that we had! Lucas also says hello to the other cordobeses. :)

I don't have a whole lot of information yet because we have not completed our packet or interview.  But, like me, you are one of the few where the fiancee is the USC and the fiance is the beneficiary (it is not as common and it can be intimidating).  So, I will try to share with you as much as I can as we continue our process. :)  The best of luck to you!

Thanks for the greetings, all!

 

One question I had was about those NVC bulk shipping dates. I've read in this thread and other threads that the NVC seemingly sends out cases to the embassies in batches every week (or week and a half? two weeks?). And I've seen people say things like "the next batch will get mailed out on X day." So my question is: how do people figure out these dates??? Are the dates for the next couple months already known?

The shipments happen every other week on Tuesdays (from what I've read in other posts from users that have high levels of knowledge and experience).  Some months have more shipments others less, since it happens every other week.  For April, the shipments are April 2nd, April 16th and April 30th.  Then, you can continue the every other week count.  Hope that helps!

Exactly like it was explained above. Shipments are every other week on Tuesdays. Today was one and the next one is on the 30th. To know your case number, you should called NVC after ten days your received your NOA2. 

In my case, I didn’t call even once, after two weeks we received an email from NVC with our case number saying that our packege left to the embassy. 

So is different in every case how long it will take to know your case number or by email or calling

I had a question in regards to the whole process.

I know Argentina treats the K1 visa as an immigrant visa even if it's normally a non-immigrant visa and usually with immigrant visas as I've read on the uscis and travel.state.gov websites, when you go the US at the point of entry, they stamp your passport with a temporary green card and tell you that you'll be getting your physical permanent green card from the DHS in a couple of months from then.

 

Now, I was wanting to know if this is indeed true once you go to the US with your fiancé since you're doing the K1 visa, that if they give you the temporary green card stamp once you arrive at the point of entry, eventually sending you the green card itself in a few months.

 

This way, it'll set aside any confusion about having to do the adjustment of status after the wedding if the Argentinean K1 visa really is treated as an immigrant visa in its procedure.

@Fernanda R Sanz Might be able to speak into this after the fact or someone else who's done it already.  But, no matter how Argentina handles it on the way out of the country, for U.S. purposes, you still have to get married within 90 days of entering the U.S. and apply for adjustment of status and so on.

I'll be traveling to the US this sunday and will be able on monday to tell you what the stamp say. 

The visa stamped in my passport is valid for 6months while Im in Argentina and durates 90 days once you are in the States.

You need to marry as soon as possible in order for the beneficiary to start the greencard process before the 90days visa expire.

With this process you fill out the forms for work permit, advance parole (in order to be able to travel ONLY under 2 emergency situations: beneficiary's family death or illnes, or the beneficiary needs medical treatment and is able to travel to his/her home country to get medical assistance that the US will not provide) and greencard. So while the greencard is being evaluated (this could take 6 to year and a half to have it), you will get the Work permit and Advance parole in 3 to 9 months.

 

The your fiance and you will need to go to the USCIS for a last interview together and separated, if they approve the greencard it'll be for 2 years, after this period of time the beneficiary will need to remuve conditions and if approved the USCIS will grant the 10 year greencard. After this process the beneficiary can stay as a permanent recident or do the naturalization, doing the history/geografy and language exam, suare to the US Flag and become an Argentinian-American Citizen.

 

The CR1 Visa is the one that grants a 10 year greencard after the interview in the US Embassy. You need to marry in argentina, wait to get 2 years of marriage.to apply and the process takes year and a half to 3 years. Maybe you got confused with this visa

Oh no no, I'm not confused at all.

 

The website for the US Embassy in Argentina states that the K1 visa is treated as an immigrant visa and usually, you are given the temporary green card/1551 stamp when entering the US at a POE on the admission on an immigrant visa.

That's why I'm asking that you get back to us to see if it is indeed the way I speculate it being since it is treated as immigrant instead of non-immigrant in Argentina.

The K1 visa does not grant a greencard. It is only a 90 days visa. In Argentina is considered an immigrant visa because they know you will do the greencard process to stay in the US after marriage, but technicaly it is a none-immigrant visa because you are alowed to stay 90 days to marry your American fiance.

 

The consul at the interview specified that I only have 90 days to marry, and once the 90 days expire I have to return to my home country or I will be deproted. This means you need to start the AOS process ASAP, before this time frame expires. 

 

So, I'm 100% sure that you are not granted a greencard when you enter the POE.

No GC issued on a K1 Visa upon entering the USA. K1 has 90 days to marry to remain legally in the US. Also must file their AOS paperwork for the GC. I've known some who submitted their AOS more then 90 days and hasn't been an issue. But I would not test the system  but stay within the K1 requirements to stay out of trouble.

This is the answer you are looking for. You will not get a stamp. 

 

The K1 visa is a non-immigrant visa with immigrant intent for ALL embassies.

Technically the K-1 is a non-immigrant visa but it is treated like an immigrant visa because of the AOS. It is kind of a ba$tard. Non-immigrant treated like an immigrant. Other non-immigrant visas do not usually end up with green cards!

 

The K-1 on its own is a single entry, short time limit visa that expires 90 days after POE. That is why it is a non-immigrant visa treated like an immigrant visa.
