He said it happens more than you'd think. Especially in AOS interviews in local US offices. He'll go to interviews with his clients and when he asks why there's a request of information or questioning anything, he right away asks for the supervisor. The CO office will admit that they don't have the authority.

If the day we had interviews was one of the busiest days and they need to to get through everyone as quickly as possible, they could have just grabbed someone and said "just interview and move on"

I didn't realize that there could potentially be CO's who didn't have "authority".Logically , they know what type of visa we are there to interview for, so I imagine that whoever we go to knows and has has the "authority' to interview us and make the appropriate decision??

Anyway we can just speculate I guess. Hopefully, next week will be a good one for all of us!

I know it all sounds very conspiracy theory... but I can see what he was talking about. During my fiance's interview, they asked him why we didn't get married while he was here working on ships. He had a CD-1 visa, which is for crew members of flights and ships to allow entry of a country for short periods of time. You wouldn't be able to get a marriage license with it nor adjust the status later. Wouldn't someone who has experience with consular interviews and knowledge of different visas know this?

Ya I can see where you are coming from. It's too bad that we are doing this the right way and simple judgment of error or lack of knowledge can ruin the whole thing. But they have our passports and that is definitely a good sign methinks!

What he said was not incorrect. There's no issue getting married with CD-1 status. You are correct that you cannot AOS from CD-1 status. But marriage itself is fine.

While I'm certainly not suggesting one should or shouldn't get married during the short stay associated with it, presumably he asked the question to try to understand the reasoning for not doing so. The specific answer wouldn't matter...but having a logical reason may.

Thank you for the clarification! Either way, we wouldn't have married during his time here. No regrets when it comes to that

My attorney is convinced that our CO either didn't know what he was doing or didn't actually have the authority to approve the visa.

COs review documents and interview applicants. Once convinced the applicant is eligible for a visa, the CO makes the approval decision and hand over the "Congratulation, your visa is approved" document. The Supervisor actually signs off on the visa before it is issued on the passport. In rare cases, a supervisor could overrule a CO and deny a visa if there is cause; this is more true of non-immigrant visas.

COs are trained to spot anomalies, and experienced ones tend to ask questions that on the surface may appear odd, but are actually intended to lead to a certain point. You have to realize, and it's been noted occasionally on this forum, India is classified as high-fraud, and Mumbai tackles all of India's immigrant visas cases. Mumbai K-1s have gotten trickier because a number of previous applicants, though secretly married, used the K1 guise to get their "fiance" into the US faster.

Marriage in the US on a non-immigrant visa is totally legit.

Never said it wasn't. We all have to do what works for us and that particular option wasn't what we chose to do. Everyone is different and should do what works for them!

Agreed

My point was more along the lines of the COs line of questioning as you related.

That's what we do now.. :)  after a relatively smooth, but 11-month long, CR1 journey. And our just completed ROC process.

My passport reached the consulate on April 9th and the case was updated on that day to reflect administrative processing. Radio silence since. You think they have made us wait enough but apparently not. I was pretty thrilled that they asked for my passport in 3 days of submitting documents so I allowed myself to get a bit too excited. Oh well!

My 60 days completed today but the thing is good Friday is tommorw  n I can't call them it's 3 holidays I 'll call on money I hope there is good news
