Question about evidence neede for AOS

I was looking through the guides and I see that divorce papers are needed when you file. But I was looking through the instructions for the I485 and the G325A forms and I don't see where it is mentioned. Are they needed for the AOS filing and if so are all the court papers relating to the divorce needed?

What your seeing is probably due to adjusting from another status... for K1, you don't need to worry about previous divorice, only current marriage!

They're only needed with the I-129F or I-130 stage of AOS, not the I-485.

It says you need it on the guide and even if you might not see it in the I-485 instructions, it might not hurt to add it.

05/28/2008 - Received AOS Interview notice

07/10/2008 - AOS Interview-APPROVED pending fingerprints

09/22/2008 - GREEN CARD IN HAND!

Removing Conditions

06/04/2010 - Sent I-751

06/07/2010 - NOA1

06/09/2010 - Check cashed

07/22/2010 - Biometrics Appointment

09/08/2010 - Card production e-mail

It says you need it on the guide and even if you might not see it in the I-485 instructions, it might not hurt to add it.

That's only for married spouses like the K-3's. Gary and Luz filed for K-1 status so they just need the marriage certificate and NOA2. (Plus the financial info, etc.)

Just submitted my AOS package last week and i included the divorce decree of my husband. I also included some documents about him to discouraged RFE.

Below was the list of the docs i submitted.

Needed or not, I included my Decree of Dissolution for good measure. Good luck you three! :thumbs: Of course it was also sent in with the original K-1 filing but what the heck, it was only one sheet of paper.

Hi ate! i just mailed of my AOS last monday. Yeah, i also included divorce decree, certification of employment, pay statement, last 3 years fedreal income tax return, but i wasnt able to include my Sealed vaccination record. Its ok to bring it later at the interview.

So basically you included a bunch of stuff they didn't ask for, but missed out one thing they did ask for. Don't be surprised if you get an RFE.

I would send them for good measure, as some have said they did. I sent mine also, as I could have sworn they were listed in the required documentation. My theory is better to avoid any chance of RFE by submitting too much. They want a copy plus original brought to the interview...even though they have a copy from the I129 file and with the petition. However, I think it's listed on the interview checklist because it's a standard list, not personalized to the individual case.

You do need divorce decree.. if they are in a different language.. they need to be translated into english..

You don't need to send in the divorce decree if you're on a K-1 and filing I-485.
