I-134 requirements

My fiance (USC) is putting together the I-134 for me right now, but he's a little worried about whether we'll hit trouble at the consulate for the I-134. We're deliberating whether we should look to his parents for sponsorship. I was just wondering whether anyone could either give me some advice or share a similar experience they had.

He has no life insurance, no mortgage, few assets (a car, no house), some savings in his bank account (roughly $1k), and his salary is over poverty guidelines (at least $23k). He works two jobs (one at UPS, the other at a catering deli), and will continue to work there after we get married.

Timeline

You exceed the 125% poverty line minumum so a co-sponsor is not needed, also assets are not needed to be reported. Keep it simple, the more financial date provided only invites the consular officer to ask more questions.

In our case this what the I-134 included.

  • I-134 signed and notarized.
  • Tax transcripts from the IRS for past 3 years, (Redundant for the (1040,W2,1099) but are free from the IRS
  • Photo copy of IRS form 1040, and W2s for past 3 years
  • Letter from my employer stating annual salary, job responsibility, and that is full time, on company letterhead.
  • Photo copies of past 6 months pay stubs up to a few weeks before the interview.

Is now a US Citizen immigration completed Jan 12, 2012.

How long has he been working each of these 2 jobs? Does he plan to continue working both indefinitely? What is his level of education (= future prospects)?

He may be OK, then again it might be a good idea for you to have a financial sponsorship package from his parents on hand just in case the consular officer is uncomfortable with your fiance's situation.

My fiance has been at UPS for 5+ years now. At the catering job, he has been there for just a little over a year. He has a B.A. from West Chester University and is planning to stay at both jobs after I move to the States.

Does he have any other dependents? That will factor in in calculating if his salary is sufficent.

No dependents! It'll be just me and him. We know he makes over the poverty guidelines; he's just concerned that the consulate will think he can't support me with what he has right now.

That's why they set guidelines and use that 125% figure. They don't really get to say "but I dunno, I see you are wearing nice shoes to this interview, are you sure your husband can afford you?"

5-3-07 NOA2!!! Two approval emails received at 11:36am

5-10-07 Arrived at NVC/5-14-07 Left NVC - London-bound!

5-17-07??? London receives?

5-20-07 Packet 3 mailed

5-26-07 Packet 3 received

5-29-07 Packet 3 returned, few days later than planned due to bank holiday weekend

6-06-07 Medical in London (called to schedule on May 29)

6-11-07 "Medical in file" at Embassy

6-14-07 Resent packet 3 to Embassy after hearing nothing about first try

6-22-07 DOS says "applicant now eligible for interview," ie: they enter p3 into their system

6-25-07 DOS says interview date is August 21

6-28-07 Help from our congressional representative gives us new interview date: July 6

7-06-07 Interview at 9:00 am at the London Embassy - Approved.

7-16-07 Visa delivered after 'security checks' completed

I-129F approved in 111 days; Interview 174 days from filing

These things are positive factors. Make sure they are known to the case officer, unlike the presentation of information that you gave in your question here to VJ. As you may have noticed, VJers will give you quick, positive answers based on insufficient information. Consular officers will turn you down given insuffient information on which to base a positive answer.
