First time DUI

Hello Everyone,

Just a quick question , as anyone seen or knows someone that got approved for citizenship with a first time DUI?

It isn't an automatic denial but it does leave  good moral character to be questioned.   Even if you plead it down you still have to disclose it.   

 

A friends wife here was denied in 2017 for a DUI that was pled down to reckless driving.

A DUI in itself does not violate the GMC requirement. But it can be a consideration. The events surrounding the DUI are also relevant (Any accident? Any other passengers in the car? Any children? Any other citations issued at the same time?).

 

People have been approved with a DUI in the filing period. People have been denied as well. It really depends on the complete case.

As others have mentioned, depends on variable factors.  Another factor that is taken into consideration is the length of time ago it happened.

 

A great factor is whether you have been placed on any sort of probation that is still open.  If so, an IO cannot approve a N400 applicant whose probationary period is still open at the time of adjudication, following their own policy.

 

The good news, is that DUI is normally not considered a CIMT unless it involves certain circumstances....and a SINGLE DUI (if misdemeanor) should not affect the GMC requirement either if no other offences in their history.

 

What was the actual charge/circumstances?  Is this alcohol-related only or drug-related where a possession charge is  also in the mix?
