Ginsburg misses Supreme Court arguments for the 1st time

At this point I don't think it's unreasonable to give her the choice of making a brief public appearance or resign. If she is too sick to make a short public appearance she is too sick to be fit for office.

   She can't be forced to resign, and there is no legal time limit in which she is required to be back. As many have said here when Scalia was not replaced immediately, there is no reason the SC can not function with 8 justices. The rationale doesn't need to change because someone is ill. Retirement is currently RBG's decision.

I agree with SB on this.  The only political option would be impeachment and I don't think this would qualify for that process.  The court functions fine with fewer than nine.  What would be a very interesting scenario is RBG leaves after 1/21/2020, what would the McConnell controlled Senate do?

I am not saying she can be forced to resign. I am saying she should be given the choice of demonstrating that she is medically fit for office or voluntarily resigning. If she chooses neither then impeachment proceedings should begin to determine if she is fit for office or not. I don't think that is unreasonable. If a sitting president didn't make a single public appearance for months at a time it would be reasonable for the public to ask questions and demand the president demonstrate they are still fit for office. I don't see how this is any different. If she is ill and needs time to recover and there is reason to believe she will recover that is fine with me. If that is the case and she doesn't want her medical condition being made public that is not fine with me. She chose to accept the job and part of the job is being transparent about your fitness for office. If she wants that information to remain private that's fine. She can resign then.

  Hopefully maintain a consistent approach, but realistically they will put the needs of the home team first. Rhetoric aside, both parties would do this.

I can assure you the Dems will keep her alive by any means possible.  Heart Lung machines whatever it takes. I am sure she will be brain dead for a long time.

Not wishing her ill will, but being factual 

 

I bet she has advanced directive calling for any means neccessary.  Will be hailed as a hero for it.

She is violating nothing, I hope she is not suffering and recovers, I do not feel the need to agree with her politics to treat her humanely

Amen that.. i wish the MDL could learn tolerance.  The far right slso, but the left has become radicalized.

I agree. However if Trump had known medical issues and didn't appear in public for a couple months wouldn't there be people questioning if he is medically fit for office and demanding he make a public appearance? How is this any different? The public has the right to know if she is still capable of performing her duties. When you take on a job like this you give up a certain amount of your privacy. If she doesn't want to disclose her medical condition she is free to resign.

Agree but the only constitution way is resigning or impeachment.  I think "without checking "  there is other constitutional ways to remove an impacted president
