ROC while awaiting I90 response

Hi everyone,

 

A year and a half ago now, right after my husband received his green card, we got a call from USCIS telling us that they found in an audit that the wrong code was entered for my husband's card. His card says CR6 and it should say CF1 (we hadn't noticed). They told us to file an I-90 for replacement due to USCIS error. We did this, in July 2017. They still have not done anything with our application. We put in a request for an update and got a canned response saying basically "we haven't worked on it yet."

 

We are now applying for ROC and including a copy of the card with the wrong code. Should I include a copy of the I-90 and attempt to explain all this in the application? I'm a bit worried this is going to cause problems...

Timeline

Include a copy of the i-90 receipt notice along with a *brief* explanation of how the card was sent back due to USCIS error and you are waiting for the replacement (but still needed to file the ROC by the deadline, and submitted a photocopy of the original incorrect GC since that was all you have at this point).  It won't cause any issues with your ROC petition (it's not like his name and other bio info is incorrect), but you'll want to keep your explanation brief and concise so as not to make things confusing for whomever is adjudicating/reading the explanation.
