Intial evidence request for AOS

Please before you feel the need to belittle my query, im simply looking for clarification not judgement.

 

We received a intial evidence request letter today for my AOS; my husband who is my affidavit, needs to send them “a complete federal income tax return submitted to IRS  for the most recent tax year”

 

My query & slight worry/confusion is now its 2019, its the beginning of January & my husband hasnt filed his taxes for 2018 yet... with our AOS packet, we sent his 2017 IRS transcript, W2, employment letter & 6 months of pay stubs.. (im a meticulous person i triple checked everything we sent & made a copy of all evidence & forms)

 

Im assuming they “lost/misplaced” his IRS transcript paper we sent... so shall we just resend the 2017 transcript? Im wondering if theyve done this in hoping he files his 2018 taxes soon now its early Jan 2019.. 😕

 

Any advice is appreciated

Personally, I would immediately  re-send the complete 2017 tax return and all schedules, W-2s, etc.  I would say that the vast, vast  majority of people have not filed yet.

Most people have not even received their W2s from employers to file 2018 returns. 
It's barely the first full week of the year! So nope- that's not even an option for you am guessing

I'll personally send 2017 back COMPLETE with all supporting schedules

 I saw this a few weeks ago where someone else sent in transcripts as well as W2s and received an RFE.  It seems that sending in both confuses USCIS as they ask for either transcripts or copies of returns with W2s and 1099s.  My advice, send in copies of the most recent filings (1040) as well as the W2s and 1099s.

USCIS will not begin to require copies of 2018 tax returns until 15th April, the date on which federal tax returns are required to be filed.

 

They likely lost the information you already provided, as you stated. Send them another copy of his complete 2017 transcript and that should be fine.

Meisha, I think you'll be perfectly fine sending 2017's. I'm sure no one has even filed for 2018 yet and they know that. You're probably right it was probably lost in the mix but at least you know your petition has been touched so that's a plus. Good luck!

I'm sure this is enough, but you could throw in a few recent pay stubs as well? 

 

I sent the IRS transcript, W-2s, and pay stubs, and my interview notice requested W-2s and recent pay stubs as well. Couldn't hurt?

We sent all this + the 6 months pay stubs & a letter from employer but the initial evidence letter requests “complete federal tax return” which we did send, assuming they have lost the tax paperwork

Oh no, I totally get that. Was just commenting based on your list above. They must have misplaced it for sure. 

 

I didn't get an RFE, but when I sent an EAD expedite, I included aaallll of the same I-765 information, which I'm sure they already had. Figured it's better to provide everything all over again just in case they don't see my passport copy and reject the whole thing. That's my thinking anyway.

I understand!

I overthink everything especially with this process. All is ok, we're just still waiting on his EAD come through. We're on day 146 and counting. Hoping to hear something this month but other than that everything is great.

Hi Meisha And Jake!

 

Right now, I and my wife are in the same situation. We received exactly the same letter requesting for the same initial evidence.
I would like to know how did it turn out for you? what exactly did you send to them?

Is the 1040 what they are asking for?
