FIANCE VISA OR SPOUSE VISA??

    Spouse receives Social Security Card and Green Card within 2 or 3 weeks after entering the US    
    Opening a bank account, getting a driver's license, etc. are very easily accomplished with GC, SS card, and passport.

    Spouse has legal permanent Resident status IMMEDIATELY upon entry to US.
   


 

Im not sure if i should create a new topic for this one.. bf's more inclined to consider k1 despite everything because of sponsorship issue. Since he aint financially stable at the moment, it would either be his mom or dad who would co-sponsor, which he's tryin to avoid. He doesn't wanna burden his parents with this. How long does it take for k1 and spouse visa to process under trump's admin nowadays? Given the fact that he's not very much in favor of immigrants?

The financial requirements for sponsors are the same for a CR-1 and a K-1 spouse at time of adjustment of status.  In addition, a Consulate Officer can require him to obtain a co-sponsor regardless if he can meet the K-1 sponsor requirements or if his income is unstable.  On average, as reported by other VJ members, the time from a K-1 submission to interview is approximately 9.8 months.  Currently, as reported by other VJ members, a CR-1 takes about 14 months.  President Trump's attempt to curb illegal immigration has no influence on the time.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

"Financial instability" and "immigration" are not compatible.  Might be wise to wait and file a petition once he has stable employment.  Neither the CR-1 or the K-1 are cheap.

Both roads will eventually require the I-864.  The sponsorship issue does not go away with the K-1.  The K-1 route is more expensive too and you can not work for 6 months.  That is a recipe for financial disaster.  


Consider the CR-1 with a Joint Sponsor if money is an issue.  

 

Both processes would take about a year.

Hi again! Is it possible to apply for fiance visa, while waiting for the result, say after 3-4months of application, get married outside u.s., continue w k1 application. Once approved, get married in the u.s again within 90days? Is that possible? Reason behind is we wanna file early, to hopefully get approved early so we can be together early. Rather than plan a wedding for 6months, get married, and only then apply for spouse visa and wait for 1more year to be together? We so confused ☹☹☹

NO!  You must be single to use the K-1.  No CO would issue you a K-1 while married.

It's either the K-1 and stay single until you marry in the US or marry anywhere and file for the CR-1 after the wedding.

There is no way to "speed up" the process.  You have to wait in line like everyone else.

There such a thing as Direct Consular Filing, basically where you can file the I-130 within the Philippines at a USCIS field office abroad. This is the fastest way to get an I-130 approved, but DCF has it's own set of rules and requirements of both applicants (often both have to be living in the DCF country at the time or have exceptional reasons as to why they are applying at that field office).

Basically, that would be the only way to "speed up" the CR-1/IR-1 process (and obviously you have to already be married), but you need to meet all the requirements the Manila Field Office has, which could be an issue since you're living in Singapore at the moment and your husband is studying. But it's an option to think about since your home country does actually offer DCF.

They won’t qualify for DCF if he is currently living in the US.
