Very confused. I am a US citizen and live in London and had to file the I-130 at the London embassy. I recently received back the approval of Form I-130. Am I supposed to wait to receive a packet to complete? (how long does that take) Or am I supposed to file form I-129. Too many options so unsure about what is faster.

Please help I am so confused and I just want to keep the process moving.

I would really appreciate any advice.

You filed I-130 to the Embassy that means you did DCF. Once your petition is approved you will receive instructions from the Embassy. If you started the process in person at the Embassy you will receive packet 4. If you started the process using the mail you will receive packet 3 fallowed by packet 4.

05/29/2007 Interview at 7.30 a.m. APPROVED Thank you, God!

06/01/2007 Visa arrived !

06/03/2007 Mayday on the plane POE Cincinnati

06/21/2007 Welcome Notice from USCIS

06/29/2007 Applied for SSN at the local Office

07/07/2007 Green Card arrived

07/09/2007 Another 2 Welcome Letters from USCIS...God, they really love me! :D

You don't need to file a I-129 (unless you're interested in obtaining a NON-immigrant visa for your spouse, which would mean Adjustment of Status and all kinds of nasty stuff AFTER you land in the US).

You should hear from London pretty soon, with further instructions (packet 3).

Do not do anything at this point. Packet 3 will come in the mail sometime soon. If you don't receive it in a couple weeks, there should be some way to contact the embassy.

I-129f cannot be filed in London and you have not filed for a K3 visa. You have petitioned for your spouse to apply for a CR1/IR1 visa, which is an immigrant visa and way better than the K3 visa. The K3 is really for couples who are separated and want to be together in the US faster than filing the I-130 at a US service center allows. Filing the I-130 directly with the London USCIS office results in an immigrant visa (either CR1 or IR1) very quickly. After you've completed Packet 3, including sending notice of readiness, you shouldn't have to wait long for an interview date and instructions on setting up the medical.

Has your UK spouse obtained a police certificate yet? That can and often takes the full 40 days.

25 May 2007 - NOA2

2 June 2007 - Received Packet 3

12 Oct 2007 - Sent Packet 3 back by special delivery

5 Nov 2007 - Interview in London - Approved without any hitches!

7 Nov 2007 - Visa and MBE arrived by SMS! :)

30 Jan 2008 - Fly to Michigan!! :)

*Note: Any delays in our case are only due to us taking things slowly
