Good day house. I had my interview yesterday (Lagos) all went well except that the consular gave me a paper to provide 2 more documents.

1, prove that I was never married to the woman that I had a child with before I married my wife (American)

2, the death certificate of the child since the child is now deceased (which I just optained today) the child recently passed which explains why she was initially on it.

My question is this what documents do I need to get to prove my first question???

I’m urgently waiting. Thank you

Get affidavit of marraid from your local office cerficate of celibacy).  Councile proving that you are not marraid. I got that from my country even when am abroad before i got marraid to my wife.

so right they don't come back .no one knows what happens there after

Ooops RFE, fat fingers.

Certainly not uncommon, but I have never seen anyone come back and say what happened or anybody on similar posts mention they have seen what happened, I certainly do not read every one but this is something I look for.

You provided a sworn statement you were married and now you expect someone to accept a sworn statement you are not. All they have to do is issue the RFE.

Yes someone adviced me to do this 11 years ago that I would get approved faster  while in the reality, I was not married to the woman. The CO asked me if I had a traditional wedding with the woman and I told her NO that I was ill advised about it in the first place.

While you were ill advised, you choose to lie about being married.  That was you that lied at the interview.  Now, that ghost is coming back to haunt you.

The problem is that most people thinks it's okay to lie to the US Embassy because visas are like a lottery.  Luck.  Nevermind that the US has computer databases and keeps all records.  Now you have a record where you applied for a visitor visa and swore that you were married.  Now you want the US Embassy to believe that you are truthful about never being married.  They should believe you now?  Why?

Once you are tagged as a liar, it makes it so impossible for them to trust you.

If a person lies to you, then later tells you a different story and said he's not lying, would you instantly believe him?  Or are you more likely to dismiss him?  That's what the CO is doing to you.  Dismissing you because you are a known liar - you admitted that you lied on the visitor visa application and at that interview.  Now you want them to believe you and trust you?

Good luck.

What document proves you are not married? How does one prove a negative?

There are documents showing that there is no marriage registered at a specific organization (i.e. certificate of singleness or local equivalent), but that does not prove one is not married.

I go back to my example in that many Filipinos can get a certificate of no marriage (CENOMAR) despite being legally married. There's just no record of the marriage by the authority that issued the CENOMAR.

Good day so If your from Nigeria you can prove that you were eligible for marriage by seeking your Bachelorhood Certificate which has to be notarized by the courts. If your parents are still alive please take them along with you when you go. If you have your certified birth cert and license that would be helpful.  My husband had to have this form before we were even married in Ikeja. Hope this is helpful .

The issue is about the previous marriage he said he had undertook.

To be clear, he lied on a visitor visa application, saying he was married, when he wasn't.  He did this thinking it would help him get a visitor visa.  Now, that lie has come back to bite him hard.  Perhaps the bachelorhood document will help.  Worth a try.  But, it doesn't erase the lie.  It confirms it.

I was waiting for you to admit to this. Embassies don;t accuse folk of getting married. I have seen this happen too many times and have yet to see anyone out of Nigeria get their Visa. Most get a misrep Ban, (5 and I have seen 10 year ban)

As Puskbrk advise get a immigration lawyer how to play this. To late to state bachelorhood fro something 11 years ago. They know in Nigeria anyone will attest to anything.

Seek counsel ASAP. Good luck.
