We got an RFE for proof of relationship, and they specifically asked for 3 affidavits. I was a bit cheeky, as I really did NOT want to be paying notarial fees for these, and submitted them as sworn statements instead, with signatures attested as genuine by our company in-house lawyer. Hey, it worked for us!

You asked for a specimen affidavit -- I drew up a fill-in-the-blank form for this and it worked just fine (see attachment).

Technically, had we submitted "proof" at the I-130 filing stage we would have had nothing beyond affidavits, as my husband and I have no community property and he is not on any of the bills. As I moved in to our flat first, my name was on everything and we never got around to putting his name to anything, including the lease. Yes, there were bills sent to him as an individual at our address, but nothing with both our names, which I seem to recall is the request.

I do completely concur that it's madness to ask for affidavits from third parties, period. However, I don't see the harm in including them beyond the hassle of getting them completed and organised. It took me a grand total of 20 minutes to draw up the document, walk around my office and ask three people who knew us to scribble down a few sentences and sign their names. Two of those people had never even met my husband, just had seen pictures of us and listened to me talk about him.

So...what am I trying to say? Oh yes. Get 'em done if you think it will help. Otherwise, eh. :huh:

Lol, yeah, you're probably right. It wouldn't have hurt to do so I guess, but I didn't really think it was that necessary at the time I sent I130. Hopefully it's just London that's being a pain. :)

Those who have never lived together in the same country can provide nothing but pretty cheesy, mostly meaningless affidavits. So, people are ruitinely approved without them.

Yeah, I agree. It definitely makes sense when filing through DCF or filing AOS when already here in the U.S.

I agree with all that has been said but i decided to provided three notiarized affidavits with the I-130. Seems worth the investment. I think it will give USCIS three other references if they choose to invesitgate our filing. They want the persons contact info including their place of birth.

I am asking three of my friends (2 that witnessed the marriage) to provide affidavits per the instructions provided in the I-130. They will be signed and notarized in California.

I was wondering if i should:

1. Provide copies or originals with the I-130

2. Provide copies or originals or none with the I-129F

3. Keep an original set for the K3 interview?

I am trying to see if i should have more that one notarized form for each of my friends.

The way I read the instructions on the I-130 you only need to supply an affidavit if you don't supply a marriage license. The only place I find affidavits is under the section of what to do if you have missing documents.

If I missed something please let me know.

You're looking at an old I-130. We are referring to the new one from 12/06. Second, a marriage license is not acceptable unless it is also a marriage certificate. There are some US States that use a portion of the License to become the Certificate but most don't. Additionally, many countries don't us a license, per se. The official marriage certificate is what is required.
