Decision made! Going for a K-3

Timeline

Alright! With the help of VJ, my fiance and I have decided to get married in the States before he goes off to school in Canada. He knows not to mention why he's coming other than to hang out with friends (which is true!) You all who have done this, was there any question in the AOS interview about entering in on a tourist visa and getting married, OR did they question why you didn't live together before applying for the visa? Just trying to think ahead!

This forum is so great, I can't wait to have some info to add so I'm a giver as well as a taker! September 1, here we come! I've got all my forms printed out and I'm practising so's to be able to send it off lickety-split.

AND we decided to ditch the lawyer.

7/26/06 - 4/12/07 - Met up in London, Edinburgh, Greensboro, Bristol, Limerick, etc etc etc

9/1/07 - Got married in US

I-130 Timeline

10/2/07 - Mailed off I-130

1/10/08 - Check cashed - yippee!

2/8/08 - NOA1

4/4/08 - NOA2

10/15/08 - AOS documents sent in

1/5/09 - Interview in Dublin

If you go on tourist visa and adjust the status, is it still K-3? :unsure:

I am still waiting for my interview but I am guessing, both of you shouldn't mention anything about getting married in the US while your fiance is on tourist visa.

Anyway, goodluck with the process :thumbs:

02/23/2017 - sent NVC packets via USPS Priority Mail (note: I have to wait for my mom's police certificate, so there was a bit of a delay before I can send the package)

02/27/2017 - packets received at 11:30 am signed by N Visa Center

03/01/2017 - Scan Date

05/06/2017 - Case Completed

05/12/2017 - NVC scheduled the interview!

06/02/2017 - Medical (06/14 to 06/15 - Dad's Sputum Test)

06/16/2017 - Mom's Interview Date (Approved!)

Good choice on the lawyer ditching since you were getting contradictory info and have a fairly normal case.

When my British hubby entered the states in Sept 2006 for a two week trip during which we got married, he said that was the purpose of his visit. He clearly stated why he was there and when he was leaving. They didn't even ask to see the proof he had brought (such as our UK lease and his letter from uni). Obviously it's your personal decision, but if the questions start coming and he says something strange and then it comes out that he's there to get married, that will raise a lot more red flags than if he says exactly what he's doing. Marrying you in the states and then going to Canada for school is completely legal and acceptable so there's no reason to gloss over it - he'll have proof of his flight to Canada right? Or at least proof that he'll be a student there in a short period of time.

So, you're asking about the AOS interview after you've married, he's been to school in Canada, and you've received the K3 visa right? I doubt they'll question your getting married in the US on the VWP since he then will have left to Canada and that will show in his forms.

I'm sure they won't question your not living together before filing for the visa - most couples don't.

Actually, all that said, it's possible there won't even be an AOS interview. I've heard of that happening.

25 May 2007 - NOA2

2 June 2007 - Received Packet 3

12 Oct 2007 - Sent Packet 3 back by special delivery

5 Nov 2007 - Interview in London - Approved without any hitches!

7 Nov 2007 - Visa and MBE arrived by SMS! :)

30 Jan 2008 - Fly to Michigan!! :)

*Note: Any delays in our case are only due to us taking things slowly

Getting married in the USA while visiting is not an issue.

Neither is not living together before applying for the visa. Few people who live in two different countries have the opportunity to live together, visiting from time to time is as good as it gets for most of us.

Hmmm... that's definitely food for thought (about what to say at POE) - we'll think on that one for sure. Especially if we get him a one way ticket to Canada! It would be good if he had his canadian student visa in hand for that but I don't think it will be ready in time...

And yes I was asking about the AOS interview - that's a great point about them being able to see that he then left for Canada after the marriage - that's pretty much proof that he wasn't trying to stay here...that relieves my mind. AND both your and yodraks points about living together after marriage... Excellent, these two things were worrying at my brain!

Question about where and when we got married never came up at my AOS interview, other than to confirm the date we got married. My AOS interview was rather anti-climactic though, ymmv. And we'd been married 4 years already by the time I got to my interview.

divorced - April 2010 moved back to Ontario May 2010 and surrendered green card
