Hello,

So I was curious if filing for Bankruptcy is a killer for someone about to file for K1 Visa? As I have read here that it shouldn't be a problem since I make well above the 125% for my future household size. Due to medical bills I am considering filing for bankruptcy but thought I would ask in case there is some grey area. It will be hard for me to find a Co-Sponsor but I figured I should be ok since my income is enough. Is there anything else I should be concerned about?

If an acceptable credit score was required then half of all Americans would be ineligible

As of right now it's not an issue (unless possibly if you raise it as one).

 

With the proposed change, bankruptcies and credit scores may be a factor in the public charge consideration. It would not ensure a public charge finding, but could be considered.

The proposed rule's comment period has expired as of last month. They may adopt the rule as-is, make changes, or abandon it altogether.

This refers to an alien's credit score and previous bankruptcies not the petitionner

True. So unless somebody raises the issue, the CO wouln't even have a way to know about it.
