Adjustment of Status from K1 visa

Hello everyone,

My fiance just arrived in the US and I'm trying to gather information about adjusting his status. 

I understand we have to complete from 1485, 130 and form for employment authorization. Each of these forms comes with a fee. I was under the impression that when you file adjustment of status there is no additional cost for the employment authorization. Is this correct? Please help.

I485, i131, i765.  The i131 and i765 are fee waived if filed concurrently or after the i485

Make sure he files the I-765 as well......There is no extra fee, and he might want to leave the country before receiving his GC.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Make sure you’re filing the i-131 which is the advance parol application. You do not need an I-130 when you adjust from a K-1 there is a big difference between the i-131 and I-130.

 

As others have stated you pay the filing fee for the i-485. when you send I-131 (AP) and I-765 (EAD) concurrently with I-485 you don’t have to pay the fees for those two documents.

i am always think that Affidavit of support  (form I-864/sponsorship) as  the part I-1765  so i sending it as the sub file for I-1765.

i tried to take a picture of the excel document i made to organize expenses and forms, couldn’t upload it :( 

 

but here are the forms youll need:

 

i485 (adjustment of status $1225 including the $85 biometric fee)

i130 (petition $535)

i130a (spouse’s biometrics included with i485 fee)

i131 (advanced parole or travel document, so he can travel outside the us while waiting, also included with i485)

i765 work permit (fee also included w i485)

i864 affidavit of support ($0)

i693 medical exam (a Civil surgeon fills it out, the form is free but the DR fees may vary, if already done for k1 i think you need to submit proof of the original, other wise he needs a repeat one, also, you can wait an bring it to your GC interview, IF you need a repeat)

btw don’t forget to go to ssa immediately and get a ssn, don’t do it like i did 😪 it took me 6 months to get it 🎉

That's correct. If the medical examination was performed during the embassy stage of the K-1 application, then there is no need to get a new one. Mind you, that medical exam is valid for one year from the date it was performed. If you file all the adjustment of status paperwork before that year, no further medical should be required. Just in case, your fiancé should keep the vaccination records at hand.

I'm very glad you get to be with your fiancé and congrats in advance! The best advice I can give you is read the instructional packets that are available on the USCIS website for each form. Read them at least twice. Be meticulous about it. Each form you're submitting must go accompanied by its own required documents (eg, form I-485 and the EAD form both require pictures. Attach pictures for each form as asked. Same with any other documents). 

Don't forget to apply for a social security number. It can be done after 10 business days of arrival. The government websites don't mention business days but trust me, the employees at the social security office (at least here in Florida) won't even try to give you a SSN before that time.

I would also suggest that you pay with money orders. I don't know why but throughout this whole process, I strongly feel they process petitions once the checks clear. I can tell because precisely when the checks cleared, then I would get the texts of receipt of petition. Our bank does take its time in clearing checks above certain amount. Money orders should be much faster.

Don't need the I130 or I130a when adjusting from a K1.  Also, do not need to do another I693, but the applicant for adjustment should include the DS3025 vaccination record when they submit the package.
