I am still a little confused on what you are asking. Are you asking must you meet or exceed the income levels from the poverty levels as quoted for the I-864? That answer is again faintly followed. Some embassy's require 100% and others require 125% of the poverty level from that document. The 125% is 100% of the time used to adjudicate the AOS after marriage where you fill out the I-864 document which is a binding contract between you and the government.

I understand that part, let me see if I can clarify. Earlier someone said that, regardless of whether or not you were required to provide the I-134, you must provide financial proof that your fiancé won't become a charge/financial burden for the government. So I'm asking, if the I-134 isn't required but other proof of income is, are the requirements the same? If that makes sense.

Ok. Now I can follow your logic. :D Yes the "other" proof is required but again some embassies will ask for it but some do not. Most embassies follow this logic and that is "if we are not interested in the I134 we are pretty much not interested in the other documents that show proof." Dumb I know but it is how it works.

 

Now here is another kicker; Some embassies require the I-134 have a "wet" signature and others a copy of will suffice. So if you belong to the embassy that requires a wet signature then you must ship the I-134 to your beneficiary, costing $75 to $100 just to have the financial package not asked for during the interview. So check with your embassy on what is required. Some will print it in the P3 others don't.

 

Ok, more good news. The financials have always given the option of either the IRS 1040 for a tax year or a IRS transcript. Now some are asking for the IRS transcript but have not changed their website/P3 to reflect this new procedure. Philippines are now issuing a 221(g) for the IRS transcript even though their instructions still say it's ok to have either.

 

NOTE:  In the event you do not have that information and also to the benefit of others who are reading our discussion I offer what that evidence is that is normally required along with the I-134.

 

EVIDENCE OF SUPPORT. You should be able to demonstrate that you will not become a public charge or be a burden on the U.S. taxpayers for financial support. A completed I-134 Affidavit of Support Form (https://www.uscis.gov/i-134) K1/K2 Interview Preparation Instructions – English (February 2014)  Page 3 of 9 with an original signature will be useful to the consular officer to evaluate your petitioner’s ability to be financially responsible for you. You should also submit your petitioner’s most recent U.S. Federal income tax return (Form 1040) and wage statements (Form W-2). Employment letters stating salaries and bank statements may be included to substantiate the I-134. Get the IRS transcript in place of the actual 1040 here: https://www.irs.gov/Individuals/Get-Transcript Use this link to determine the income levels needed https://www.uscis.gov/i-864p.

Most times it is sent via email.

Quick question on documents needed for the interview in Brazil:

 

Should the beneficiary have an original and a copy of everything I send?

In other words, I know he must have an original and a copy of proof of my divorce.  Does he need an original and a copy of the I-134, proof of relationship, my financial support, etc?

I-129F packet sent = 06/15/2018

I-129F NOA1 = 06/21/2018

RFE = 12/19/2018

RFE response = 01/12/2019

I-129F NOA2 = 01/19/2019

NVC received = 02/14/2019 ♥️

Embassy received = 03/07/2019

Interview = 05/07/2019  Requested more documents.  Returned beneficiary's passport to him. Submitted documents 6/3/19. Email received saying they were received.

Emailed Consulate = 08/02/2019 asking about visa. Received email stating they had never received the documents. Sent documents again. 

Phone call from consulate = 08/07/2019 saying they were approving the visa. Fiancé has to send them his passport. 

Passport returned to consulate (in person) = 

Visa received = 09/05/2019

Entry into USA = 10/24/2019

Married = 11/23/2019

AOS sent =

Here is what is needed for Brazil. I went through it quickly and it does address your question in fine detail.

It doesn't make much sense that you are asking a question that is specific to your embassy amongst those who have never done this before and are from a different country. So, I highly suggest that you become members to this thread were a lot of chatter about the process for the Brazil Embassy and interview is taking place.

Yes the 11/30/2018 is still the current form to use. I always recommend that you get your forms from the OFFICIAL government website. Getting it from somewhere else can at times give you the wrong form and cause a RFE or 221(g). Government website forms are ALWAYS the most current that they will accept. Most times their is a grace period whereupon you can continue to use the "expired" form but usually only equates to a few months. With it be expired I would recommend waiting till you are out about 30 days and then return to the government website (https://www.uscis.gov/i-134) and secure the latest copy.

 

The I-864 is not used at this stage of the interview process it is only used when filing your AOS package after marriage.

Thank you as always for your brain @Greenbaum it was the expiry date that through us completely, and because we got RFE's during the i-129 stage we didn't want to bring the wrong thing. We want to get it done now as my fiance will be in Ireland from Friday for a week, again trying to be prepared as much as we can, should we wait before completing it?

Posting this update to see if anyone has ever experienced a similar incident.

 

Soooo...our case was sent to Sydney Embassy last week, was scheduled for delivery today Monday the 11th (Australia time). I was tracking the delivery via DHL throughout last week. I checked the DHL tracking this morning excited to confirm that it was finally received and to my dismay it had NOT. It appears the DHL Courier attempted to deliver the package after the embassy had already closed for the day so no delivery was made.  (Fiance says they close at 4:30pm)

 

I know they will attempt delivery again tomorrow probably, so I still think no reason for us to be overly worried yet. but would be lying if I said this wasn't causing a little mild worrying. I'm curious if anyone knows how the Embassies handle these kind of delivery issues? is this common?  I read on the DHL website that they only attempt 2 deliveries and if both fail they will only hold the package for another 5-7 days before shipping it back to sender??😐

 

@Greenbaum any past cases you are familiar with where this has happened? I still situation unusual or common? Just not sure what to make of it.
