There are several sources that must looked at in whole.

 

https://www.uscis.gov/working-united-states/working-us

 

1) You must have a Green Card, EAD, or a work related visa to work in the US,

 

2) "Nonimmigrants [who] enter the United States for a temporary period of time, and once in the United States, are restricted to the activity or reason for which their nonimmigrant visa was issued."

 

This means unless you have a visa that allows you to work, you are not allowed to [work]. K-1 visa is not a work visa. 

 

You do not become an immigrant until your adjustment of status, and therefore the quickest you are allowed to work on a K-1 visa is once the EAD has been issued.

After being admitted to the U.S. on a K-1 nonimmigrant visa, your fiancé(e) may immediately apply for evidence of work authorization by filing Form I-765, Application for Employment Authorization. Your fiancé(e) may also apply for work authorization at the same time he or she applies for a Green Card. In this case, your fiancé(e) can file Form I-765 together with the Form I-485. Your fiancé(e)’s work authorization is valid for one year and may be extended in one-year increments. Once the green card is issued the work authorization is now based on the validity of the GC.

Take the DS-160 that you have already completed with the error and inform the CO that you want a correction made to the unticked box that you now want ticked because you did receiv and read the IMBRA pamphlet. There is no harm in doing this. There are many who ask the CO to do this for them. Do not create a new DS-160 for this little error.

The best time to submit your DS-160 is when your case gets set to "ready" and before the interview. Doing it sooner is ok but I much prefer to complete it between those two markers. Read the form and instructions and you will see that it says you the beneficiary must submit the form.

 

Remember all those links I gave you. Well the P3 letter link ask the BENEFICARY to complete those items there for it is the beneficiary's responsibility to submit the document.

Other people can assist you with your visa application. Note that under U.S. law (22 C.F.R. 41.103) you must electronically sign and submit your own application unless you qualify for an exemption. Even if someone else helped you complete the application, you (the applicant) must click the “Sign Application” button, or your application may not be accepted.

 

Signature. The Form DS-160 shall be signed electronically by clicking the box designated "Sign Application" in the certification section of the application. This electronic signature attests to the applicant's familiarity with and intent to be bound by all statements in the NIV application under penalty of perjury. .

We just received our NOA2 last week on January 15th. 

 

Already, we have been asked by friends and family when I'm scheduling my interview 🤦‍♀️ 

 

So since I'm new to this, I just wanted to ask on here; when are we able to schedule the interview? Is it after the embassy receives our case from NVC

- I live in Canada and I'll be going to the Montreal consulate.

You can't hurry it along at all. You have to wait for P3 which takes 2-4 weeks from Ready. Comply with what they ask for in P3 (the actual one they send you) by sending them a copy of the signed P3 checklist, your DS-160 confirmation and your Passport Bio. Then they send you P4. Then they tell you to register to schedule and you'll wait some more for interviews to open up, which only happens once a month during the last week of the month for two months ahead UNLESS you are lucky and you scoop up a cancellation. Get your medical appointment first so you can schedule the interview shortly afterwards.

Hey! We are ~ 6 weeks ahead of you. I'd say your interview will be at least 3 months from now, based on current wait times of other Canadians ahead of me. They are booked up until March now and it'll be awhile before you (and myself) can even book our own interviews. Keep us updated! Hopefully your case moves to the NVC faster than ours did.

Hey,

 

I have my case number from the NVC, the status is 'AT NVC'. 

 

Is there anything I should be doing right now? or do I wait for the status to change to 'In Transit' to book my Medical? 

 

I haven't had anything in the mail yet, do I wait for a letter before completing any further steps.

 

As mentioned previously, I have my police certificate, it came last week. I have my medical records (vaccines etc.) Is there anything else I need or should be trying to obtain?

Here is some information including the Embassy P3 for you to get a head start

 

P3 Letter

Usually you will not receive the P3 letter in the mail. Do an online service request. They will respond typically in 2 -3 days with the instruction (P3). You will need to submit D-160 and pay the visa fee, then schedule the medical afterward. Technically, you will need the P3 to complete the medical exam, although some have gotten by with just the interview confirmation. I wouldn't risk it and would just request that they email it to you via: https://vn.usembassy...a-inquiry-form/  When using the form be sure to add in the comments section the last 4 digits of your SSN or they will email you back asking for it which causes further delays.

@Greenbaum Thank you , this is so helpful ! I am the petitioner 😃 So my fiance will not receive packet 3 in the mail? I will let him know we need to do the online request. He was wondering if his documentation needs to be translated to english like the rest of his information was when we completed the I129F , such as his record check? I guess I will have to wait until I get our case number before we can get started on any of this.
