Right.  Not really.  Living together 3 years trumps everything else you could combine in terms of evidence.

Correct. Unfortunately, if you open a shared bank account NOW and just send a single month (this first one) of statements in January that will not be very convincing.

However, honestly you HAVE to show some sort of financial co-mingling if you want to avoid an RFE....since it doesn't sound like you have ANY proveable financial co-mingling, I would recommend opening the account ASAP. That way if and when you get an RFE at least you can send several months of statements in response to the RFE. While USCIS does want to know, of course, that you live together, this is not the only evidence they want to see to feel that your marriage is legitimate....

This is why it is important to start thinking about the application and the materials you will need much longer in advance. One month is not enough to build proof, they want to see that the co-mingling has been there all along. Prepare for an RFE.

Baloney.  Open the account if you want.  Jcra615 needs to read those I-130 instructions again and take literally, that the list of items that follows the words "In addition to required...."  simply IS NOT required.  You've lived together three years. That REALLY DOES....TRUMP....everything and anything else you could provide in the way of "additional" evidence.

Hmm... Here is what the form actually states...

NOTE: In addition to the required documentation listed above, you should submit one or more of the following types of documentation that may prove you have a bona fide marriage:

(1) Documentation showing joint ownership of property;

(2) A lease showing joint tenancy of a common residence, meaning you both live at the same address together;

(3) Documentation showing that you and your spouse have combined your financial resources;

(4) Birth certificates of children born to you and your spouse together;

(5) Affidavits sworn to or affirmed by third parties having personal knowledge of the bona fides of the marital relationship. Each affidavit must contain the full name and address of the person making the affidavit; date and place of birth of the person making the affidavit; and complete information and details explaining how the person acquired his or her knowledge of your marriage; or

(6) Any other relevant documentation to establish that there is an ongoing marital union.

It clearly states one or more types of documentation given on the list. Did I say she should not submit a lease? Clearly, I did not. I said that showing co-mingling of finances is important, as it is stated to be a proof of bonafide marriage, and that opening a joint bank account is a way to show that. She can go ahead and JUST submit leases or JUST birth certificates or JUST affidavits if she wants, but as I said, prepare for an RFE in that case. They are not checking items off a list, they are looking for a broad picture of a valid marriage, which all of these items attest to, but do a poor job of demonstrating alone. Especially from a high-fraud country like the DR, it is much better to show more rather than less.

The nice thing about written public forums is that there's no hiding what is actually written.

Regardless of your assertions NOW, this is what you wrote.  "However, honestly you HAVE to show some sort of financial co-mingling if you want to avoid an RFE....since it doesn't sound like you have ANY proveable financial co-mingling, I would recommend opening the account ASAP"

That quoted statement is simply FALSE.  The vast majority of spouse cases we see here provide ZERO evidence of co-mingled finances.  ANYTHING in the list you've shown follows the words "In addition to the required...."  In most cases the "one (or more)" tends to fall under (6) such as evidence of time spent together in person, examples of how and how frequently the couple communicates, and photos together.
