From browsing other filing months I know that the NOA letters are delayed. I might not get it before my green card expires. Do I need to get an infopass appointment before the card expires? Or can I wait till when I actually need to travel(July/August)?

 

Quick rundown on my filing so far. 

Jan 7 - mailed to Texas lockbox

Jan 14 - e-notification receipt SRC

Jan 15 - check cashed

 

GC expires Mar 9

Timeline

We are prepared to mail our ROC documents tomorrow. I've just been reviewing the I-751 to make sure my wife(petitioner) and myself(spouse) signed in the proper areas. I reviewed an earlier post to get my answer on signing Part 7 and Part 8.

My wife and I prepared the petition ourselves like so many of you did. However, I just want to make sure that I do not also need to sign Part 10 of the petition. I am starting to overthink...Can anyone comment as the petitioner's spouse on signing Part 10 in addition to Part 8?

You do not need to sign Part 10. Only if you prepared I-751 on behalf of your wife, then you need to sign it. If she did it herself - you do not need to sign it.

01/24/2019 - received the response to e-Request via e-mail, which says: "Please allow 30 days from the date of this correspondence for the notice to be sent".

01/28/2019 - received NOA (the extension letter), which extends GC for 18 months

01/29/2019 - received biometrics appointment letter

02/08/2019 - biometrics completed

I *think* (and someone please correct me if I’m wrong) that even without the extension letter, your status remains, so while you wouldn’t have physical proof of your status, if someone was to look it up, say an employer doing e-verify, it would still show you as authorized to live and work in the US.

 

Of course, if you’re traveling you would need proof.  

 

If I’m correct, I’d say wait it out until maybe 6 weeks before you are traveling to ensure you can get the stamp, and also allowing some extra time for the extension letter to arrive.

My husband the other day said he doesn’t expect me to sleep right until after a naturalization ceremony so I can finally be done.  I must drive him absolutely nuts.  Haha

 

It was a good 21 month break without worrying about anything aside from making sure my green card was in my wallet.

 

I’m just looking forward to when this thread starts having approval messages roll in.  Or at least extension letters :)

I believe you are the petitioner in this case. The conditional green card holder and your wife.. the u.s citizen is the spouse..

If you have other strong financial evidence, go ahead.  Who knows how long until you would get a 2018 transcript with the shutdown.

You would definitely need the I-551 stamp before travelling out of the country if you don't have the NOA1 letter. Also if you start a new job, unless you have an unrestricted social security card.

Upon receipt of a properly filed Form I-751, the alien's conditional permanent resident status shall be extended automatically, if necessary, until such time as the director has adjudicated the petition.

 

However, I would suggest getting I-551 stamp before your 2yr GC expires if you don't get the NOA letter. You should always have some documentary proof of current lawful status in US, particularly, if you live/travel in any of the border states (North & South borders both included).

I thought I would bring up a subject that I have not seen mentioned. When you get the green card extension letter, check your driver's license. I don't know about other states, but in Arkansas, the driver's license expires on the same date as the green card.

Yes, this correct. As per CFR§216.4(a)(1):

Upon receipt of a properly filed Form I-751, the alien's conditional permanent resident status shall be extended automatically, if necessary, until such time as the director has adjudicated the petition.

 

However, I would suggest getting I-551 stamp before your 2yr GC expires if you don't get the NOA letter. You should always have some documentary proof of current lawful status in US, particularly, if you live/travel in any of the border states (North & South borders both included).

I am in Buffalo, NY, so literally on the border.  I see DHS vehicles every day.  I will definitely be getting the stamp if I don’t have the NOA1 by April, just to be safe.

Thank you. My strongest evidence we have that is our son birth certificate:)
