I 864 tax return question

Hello everyone:)

I am the petitioner and I met my wife in New Zealand (she is from France). Our I 130 was approved recently and I am now working on the I 864 form. I left USA in early 2016 to work and travel Australia for one year, then I did the same in 2017 to New Zealand where I met my wife. 

 

I have not worked in the USA since 2015 and have no tax records for 2016 and 2017, should I submit proof of my travels with the form to say I wasn't earning taxable income in the USA or just attach my 2015 text return as that is my latest?

 

My mother is co sponsor of my wife and she will submit her tax returns on a separate I 864 form. 

 

Your help would be greatly appreciated.

US citizens are REQUIRED to report (and pay tax if needed) on income earned world-wide, not just income earned inside the US.  You will have to file back-taxes........

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

You must report the world-wide income. However, if your income is not meets the filling requirements, then you do not need to file tax. For any year you not file tax, just type a letter included which i864 package and explain that your income not enough to file tax.

As noted, you are required to file taxes for any year in which your worldwide income was above the minimum thresholds. You may not owe any taxes due to the FEIE and/or FTC, but filing is required in order to claim those exclusions/credits.

 

You must have filed for at least the past 3 tax years in order to submit a qualifying I-864 (which you must do even with a joint sponsor).

You must provide a copy of the most recent tax year's tax return (transcript is the simplest) along with the I-864. This is currently tax year 2017's tax return.

If you weren't required to file for a year, then a letter explaining why can be provided.

Or, simply hand write in the available space.  "Income below filing threshold."  If true, that's all the explanation they need.
