Hi guys,

My husband was unable to file his tax returns for the last 3 years in time. He just recently filed for 2015, 2016 and 2017 along with the W7 form. We recieved my ITIN and 2015 Federal refund got processed and my husband recieved the cheque with the money that the government owes him for 2015. The problem is that the cheque has both our names on it. How do we cash it out? Since I am not there yet, I can't physically sign the cheque. Also sending it through post is very expensive and takes a long time. We are also expecting refunds for the other two years. How do we open a joint bank account without me being physically present  in the US? How do we cash out the cheque that's in both of our names?

 

I would appreciate your advice. Thank you!

i had this problem once ... I had produced a limited power of attorney document to my bank, on her, and  they deposited it into my account.  

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

Hi Darnell, thanks for you response. How did you get the limited power of attorney document? Did your wife write a consent letter to obtain that? Or instead do you know of any banks thay would let us open a joint bank account without me being physically present in the United States?

I'm sorry for so so many questions. I am not very familiar with the tax processes.

well, it's a bit different in china .... 

 

and it has to match the legal requirements for my state - 

 

so - find out what is a good template for your state where you live, then write one up.  Email it to her, have her print it out, have it somehow notarized back in India, then have her send it to you via postal mail or fedex - as you need to show an original signature ... 

 

that would be my best guess - i don't know anything about notarial documents or legal process in India ...

Me and my husband filed our last 3 years of taxes late due to some personal reasons. We have been married since 2015 so along with the 2015 return we filed for my ITIN number which was issued and our 2015 refund was approved. But for the other 2 years, they only put in the system yesterday. The representative on the phone told me not to call again till 21st February. Our case has been at NVC since August this year because of our taxes. Can we just send them copies of our 1040 form? We have all the other documents ready. I tried calling NVC but representatives are unavailable maybe because of the holiday season. Please advise me on what I can do! Thank you!

2015 transcripts are available online. 

We filed 2015, 2016 and 2017 at the same time. 2015 along with the ITIN number was approved and I can get the transcript for that year. The reason why we filed the 3 years together is because we recieved a letter from IRS stating that if we don't file all three years of taxes within the next 30 days from the return they will not give us the refund they owe us. So we got all three years ready and filed quickly. 2015 was processed so quickly but the other 2 returns are over 6 weeks and they told me it was only put in their system yesterday. I don't want to wait any longer. If it's possible, I want to go ahead and submit my husband's W2 and 1040 for 2016 and 2017. The only issue with the 1040 is that we foled them together and I didn't have the ITIN number so the for my social security/ITIN it says "Applied for". I could print fresh forms, put my ITIN in there and submit it to NVC if they accept it that way.

How did you file your tax returns? Electronic or snail mail?

 

If you filed electronic, I would print out Form 9325 acknowledging that your return was transmitted and successfully accepted by the IRS. I would submit this along with your 1040 as proof that you've filed your tax returns.

I would then send what you have along with the W-2. Just make sure the 1040 is signed by both of you.
