Well here goes... I am in the process of applying for a K1 Visa to allow me to enter the US to marry my fiancé. I am making payments to my car through a finance company on a 5 year deal. So far I’m into my 4th year of payments but now seeing as I’m planning to move country I may need to make arrangements for them to repossess the car as I cannot realistically take it with me. I guess this will totally mess up my credit so I was wondering whether this would have any bearing on my Visa application?

Any info would be much appreciated

No, credit status has no effect on visas whatsoever.

Credit will not even trasfer to the US, you will start with someone who has no credit. But if you were to ever return, leaving bad credit may not be the best thing to do. If you can, sell the call and pay off the rest of the loan.

I am the USC, who has some credit issues. It had no bearing on our applications.

1/23/07: I-129F packet received and signed for at 9:45A.M.!!

1/29/07: NOA1

4/27/07: NOA2

5/01/07: NOA2 Hardcopy received

5/10/07: Approval arrives at NVC

5/14/07: Leaves NVC

5/17/07: Arrives at Bogota, Colombia

5/18/07: Packet 3 faxed to Embassy

5/22/07: Packet 3 sent via courier

5/30/07: Wendy receives packet 3 (Good thing we used the shortcut)

6/04/07: Packet 4 received

7/03/07: Medical appt. scheduled

7/05/07: Interview!!!! VISA APPROVED!!!!!!!

7/09/07: Visa in hand!!!

7/11/07: Point of Entry at LAX, complete success!!!!!!!!!!

7/24/07: Married!!!

07/27/07: Filed for AOS & EAD

08/02/07: Arrives at Chicago

09/10/07: NOA1

09/11/07: Social Security card in hand

I wouldn't worry about it. By the time your visa comes through you'll be nearing the end of your "5 year deal". :lol:

But, should you get your visa before the end of your financial contract, is there not some other means of settling the balance without ruining your credit? (And, no, bad credit does not have a bearing on a visa application.)

Why not try to sell the car...or perhaps you can 'sell' it to someone who has bad credit, can't get a car-loan otherwise, but is willing to take over payments for your car. As others have said....if possible I wouldn't 'make arrangements' to have the car repossessed....as you never know when your left behind bad credit may bite you in the butt. That said....personal credit situation has no bearing on your visa application. (i.e. they don't check your credit as a condition of issuing you a visa)

Sell the car back to the dealer, I suspect that what it is worth should be enough to pay off the loan.

I should be able to sort out something without resorting to having the car repossessed. I just wanted some info incase my worst case scenario happened. I've been told from a friend that I cant legally sell the car then pay the debt off because technically the finance company still owns it. I dont know how true that is but ill be making enquiries with them tomorrow.

That is exactly what a person does when they trade a car in on a newer one before the loan is paid off. That is why I said sell it back to the dealer.

Have'nt ever heard of anybody in the U.S. ever having a warrant issued for unpaid parking tickets. Worst that might happen is they impound/boot your vehicle if they run across it. Still a good idea to get it taken care of.

I got this ticket a while back and completely forgot about it. Then last month I receive a letter from a collection agency that I owe 1100 bucks. So I dont have that kind of cash to pay for that ticket right now....mmmm should I be worried??? I need whatever money I have now to purchase plane tickets for myself and fiance.

Should I be scared for getting a warrant? Since the courts sold the ticket to a collection agency.??

I doubt your license will be suspended or will you they put out a warrant on you over a parking ticket. But if you do park in the same jurisdiction again, don't be surprised if your car gets impounded.

$1100 dollars is alot for a ticket, you can try to negotiate it down, but considering how long you put it off, i doubt the county is going to be very helpful. I've gotten tickets here in Minneapolis that I didn't quite pay on time. I did manage to negotiate them down a bit.

Credit history has no bearing with Immigration process. However, it is good to take care of the car and credit issue. It is not good to forget about parking ticket.

I-130 Timeline with USCIS:

It took 92 days for I-130 to get approved from the filing date

NVC Process of I-130:

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview

Depends on the state. It USED to be common all over. It could also be entered as a county or municipal warrant...not sure where...Wisconsin stopped that a long time ago, now we just take your car.
