My case is outside current processing time

Hi all, I will need all the advise from anyone here that can help me, i file for my adjustment of status since September last year, and now my case is outside the current processing time, i have never been sent or scheduled biometrics appointment as stated in the first notice they sent me about 9 months ago. presently my district are processing october 14 2006 applications while mine was September 21 notice, and i have not recieve any notice whatsoever. What step should i take for now. Please do write, anyone that knows more.

Make an infopass appointment and contact your state senator to make an official inquiry.

It's very troubling that you never received a biometrics appointment...even moreso that you wouldn't inquire about it much earlier. Scheduled an infopass appointment asap and hope they didn't send you a notice you never received.

It's very troubling that you never received a biometrics appointment...even moreso that you wouldn't inquire about it much earlier.

Its not that uncommon if they didn't apply for EAD with the AOS to not have a biometrics appointment quickly. However I agree with others here, an Infopass appointment should be made ASAP.

OP: I noticed in your signature that your CIS for the EAD was Chicago, while you listed Philadelphia as the CIS for your AOS. I'm just wondering if you sent your AOS application to Philadelphia instead of Chicago?

I guess that makes sense if they didn't apply for EAD, but I thought that biometrics were generally taken within a couple months after NOA1 regardless of having applied for EAD or not.

Nope. If you apply for plain AOS, sometimes biometrics won't be taken until many months after the application, sometimes they are even taken on or after the interview date.

I sent my AOS application to Chicago, I am residing in Philadelphia, I have in 2005 applied for EAD and have recieved my work authorisation January 2006, I applied for AOS 15th september 2006 and get a notice 21 september, since then I have not been scheduled for biometrics uptil now. I have called on the 15th of April 2007 and was told within 45 days I will be contacted, and uptill now nothing have been sent to me, I have scheduled and infopass appointment and was told that they are only waiting for my background check. Uptill now nothing have been heard or seen as regards this application. I cam here on a K3 visa which will expire on the 27th of September 2007.

We are in the same boat, I filed in April 2006 interviewed in July 2006, touched in August 2006, and nothing sense. I have had two or three info pass appointment, We were told they were waiting on a back ground check, I suppose this means the FBI name check? weard cause I was told by our Senators office that our security clearance cleared, but we were issued the wrong a number or one that had already been assigned :blink:

OK, I don't really understand why you filed EAD and AOS at two different places at two different times (EAD first?), but I would assume, that it is okay if you had your biometrics taken once, the data should be in the system for the AOS as well.

To your initial question- as far as I know, you can request an official inquiry on your case 6 months after you areover the "magic" processing date listed on the USCIS website.

But I guess an infopass appointment won't hurt to find out what exactly is going on with your case.
