Correct. But you don't need a waiver...you need to overcome the reason for refusal. That would be via a joint sponsor.

I called them yesterday, Through phone, and the woman cannot answer my inquiries, after a long minutes of waiting she then told me to contact USCIS.

That is a call center ... of course she can't help you.   But like said your case file is at the embassy still .. for now.

Are they going to send it back to USCIS? Is the application going to be terminated or canceled?

Yes and i really appreciate it. We are starting on doing the joint sponsorship now. We can send the documents before this week ends, if no delays.

At the moment that may depend on you.    IF you get a co-sponsor accepted then neither.

I kinda feel bad for the OP because it seems like her SO does not want to use a cosponsor at all even after being told that they need one.

Yea, I was kinda thinking the same thing in the back of my head as well.

 

But you know how the Philippines is, Communication Breakdown and miscommunication is normal there

Just when you think you have TDS eradicate,  a new case shows up.

Your on the right track now, but  you never should have sent the application without it being completed. Knowing that you didn't meet the income requirements and ignoring it was your first mistake. Once you send this in and as long as it meets the requirements then for now you will be fine. Good luck and keep us informed.
