Will not sending i-693 with initial package delay EAD?

Hi all,

 

I'm getting ready to submit the AOS package (from F1, marriage-based). I know that USCIS says you can submit i-693 later (even at the adjudication interview), but I got worried - if I send the package without i-693, I will receive an RFE, but will that delay/stop the process on adjudicating the i-765 application for a work permit (EAD)? I am in Minnesota, where processing times are incredibly long. On the one hand, I don't want to pay twice to get the medical examination if it expires, but at the same time I don't want to risk delaying receiving a temporary EAD.

 

What have been other people's experiences with this?

It won't be an RFE, but a courtesy letter instead.

I would wait until my interview is  scheduled.

No, the omission of the I-693 wont delay the approval of your EAD

psgma, I see your timeline in the signature? Did you apply for an EAD and did you receive it already?

Yes, I applied for it and received it 2 weeks after i responded to the RFE. You  should expect between 4 to 6 months to get your EAD

We did not send the I-693 with the AOS package. USCIS recently updated the terms of validity for the I-693. If you file for AOS and submit your

I-693 within 60 days of completion of the I-693, then it remains valid for 2 years. 

 

It is entirely up to you.  If submit it now, then you get it out of the way. Otherwise, you may wait until USCIS schedules your interview. I am sure you are aware of the current processing times for the Minneapolis Field Office. 14 to 25 months. Our PD is 03-16-18 and we are still waiting.

06-15-2021 - Case was updated to show fingerprints were taken. 

05-26-2021 - Received NOA/extension letter. Notice date and postmarked 05-20-2021.

05-23-2021 - Received text message with Receipt #. YSC Potomac Center.

05-21-2021 - Checks cashed (processing on joint checking account)

05-07-2021 - I-751 received in Arizona.

 

Marriage-based AOS - Concurrent filing.

05-07-2019 - AOS Approved. Resident since date 05/07/2019.

05-06-2019 - AOS Interview

04-23-2018 - "Case is ready to be scheduled for an interview"

03-16-2018 - Priority Date.

Be ready to wait for 6 moths.

The NBC processes the EAD/AP. It has been pretty consistent. I see most people getting the combo card within 4 to 6 months. You may, of course, request to expedite, if you meet the expedite criteria. 

 

Here is the data from the Minneapolis office. Some people have waited as little as 10 months & 5 days for the interview and others as long as 16 months & 26 days. Of course, the sample size is small but it gives you an idea of what to expect. The first thing that stands out is that they're not actually going in order.
