denial and reactive?

Had bad news that my petition had denial; they said that the signature at the husband divorce decree was unclear.

He got the digital signature finally and he appealed the petition last week.

Our ex lawyer said it will take 12 or 18 months to process this, is it true?

Is it possible to reactive the approved petition? It has been approved last may 2006

I don't understand your post. You had an approved petition a year ago that you abandoned? And now you have a denied petition because of an ambiguous signature on a divorce decree of the USC?

Appeals can take a while (depending on your situation). I know ppl in the past just re-applied b/c it appeals can take a long time and it can be cheaper. Did they send you a RFE?

Last may 2006 our I-130 approved, we did not abandoned it, but uscis could not locate our approved petition. When my husband called 800, they asked him to refile I-129 and I-130 and we did it and denied.

Or could we do DCF? my husband lived in Jakarta more than 6 months?

You can file DCF in Jakarta - at least I know last year there was no residence requirement.

It is difficult to provide any guidance with so little information. Perhaps if you could provide more cronological details, we could see the picture more clearly.

I take it you have already refiled at least an I-130 and this time with the appropriate signatures. When did you do that and exactly what was the response from USCIS?

Here are the chronological details;

July 2005 filed I-130, approved May 2006 but USCIS lost it (we called them and asked where is our approved petition, and they suggested to refile and we had a very bad lawyer)

October 2007 refiled I-130 and I-129 denied

We contacted the congressman and they will try to reactive our old petition but so far uscis can’t find it, ah well

Thank you all, we will check the requirements to file DCF in Jakarta and if we do DCF is it ok since my husband appealed the case?
