Hey guys,

I have another question.

Is it true that the DCF isnt working like it used to anymore?

And is it also true that if we apply for the CR-1 Visa, I wont be able to visit the states until it is getting approved?

"Applicant will most likely not be able to enter the US during this time."

That wouldnt be nice at all!

If that is the case, we will most likely go with the K3-Visa.

DCF has been reinitialized in all Consular posts as ordered by the Dept. of State on, if memory serves me right, March 21. I am doing DCF and it's a long boring process, but the fact is, once I get my CR-1, I am done. Have you checked with your nearest Embassy/Consulate about this? Do tell. The best source of information is always the Consular post itself (except Montreal, but that's another story LOL). just my two cents.

Hi Lara,

Take a look at my timeline. I should get my visa next week, and it will have taken 7mths for the entire process. It may take longer for you depending on where you have to file your petition. And how busy your consulate will be.

Also, I flew to the US twice and stayed the max 90 days each time during this process. So I spent the majority of the process in the US with my husband. He filed the petition a few days before I arrived so it wasn't in any system so the Cutoms Officer had no idea I was applying for a visa. The second time I entered the US the visa was on its way to the NVC (second stage of the journey) and I was also with my husband, no question asked of me compared to when I am alone. In the past 3 years I have entered the US about 8 times and never really had a problem. I didn't have any paperwork that showed I had anything back home I had to go back to. The last few times I travelled with our small son which probably gave me more reason to stay in the US, but still no problems.

We chose the CR-1/IR-1 route because I am tired of flying b/w the 2 countries and it seemed faster at the time.

06-04-07 Received VISA in the mail. Silly Consulate issued me CR-1 instead of IR-1, no time to change it in Australia, will try to change it once in California.

06-10-07 POE SFO

06-21-07 Receive SSN#

07-12-07 Receive Green Card in the mail STILL HAD CR1 INSTEAD OF IR1

12-10-07 Finally sent I-90 asking for a new green card with correct info.

06-17-08 INFOPASS - Was told USCIS sent new green card to old address back in Jan. Will resend it but may not be able to correct error as it was made by Consulate not USCIS.

What to do now??

Hello,

my name is Lara and I am new in this forum. Right now I am engaged to an american and we will get married

on the 4th of June, 2007 (in two weeks! :D ).

So after that we will apply for the visa as soon as possible. Right now I am still living in Germany and I will have to stay here until January of 2008 because of my job. :angry:

I already spent hours and hours of trying to figure out what we will need to apply for... and as soon as I thought I had most of it figured out, I read about the CR-1 Visa.

We wanted to apply for the K3 Visa... (I-130). I was never really sure though what the I-129F does...

So I would be so happy if anybody could explain to me what the difference is between the K3 and the CR-1 Visa... and which one will be better and quicker!

And is the I-129F necessary? What exactly is it for?

I am still a trainee right now and will (hopefully) be done with it in January of 2008. So thats when I plan on moving to the states... so which Visa would be best for me?

I thank you so so much for your answers and any help... because we will have to start applying for it right after the wedding. Just so we dont have to be apart longer than needed.

Hi Lara,

If your soon to be husband lives in Germany and has lived there for at least six months you will be eligible to file directly through your US Embassy in Germany. Check the Embassy site for their exact proceedures for your country. It is usually much faster to file through the embassy. However, if he stills lives in the US you and you choose to file for a I130 the processing center in the US will create a CR1 application for you automatically.

I think you are better off with the CR1 (DCF) way instead of the K3 since AOS Fees are going to be rocket high starting July the 30.

The only thing that has changed with the DCF is that the Adam Walsh law came in effect but the time difference isn't to bad and you only would have to file removal of conditions in the states instead of AOS and removal of conditions.
