Petition returned to USCIS through NVC

That is what the refusal letter stated.  It was delivered with my wife's passport.  We had no idea we were refused until we saw that in CEAC and got the tracking number from 2GO.

PHILIPPINES ONLY!!!  CFO (Commission on Filipinos Overseas) INFO - Can't leave home without it!

 

PDOS (Pre-Departure Registration and Orientation Seminar) is for ages 20-59.  Peer Counseling is for 13-19 years of age.

It is required to have the visa in their passport for PDOS and Peer Counseling.

 

GCP (Guidance and Counseling Program) is for K-1 Fiancee and IR/CR-1 spouse ONLY.

It is possible that they knew about an imminent refusal but that would come later at AP or with the CO if they determined to refuse at that point.

You're right.. Pretty scary though, if only we could turn back time that was wasted.. But oh well.. It is what it is...

Yep.  We weren't happy about it but we were not going to let a little thing like a refused visa keep us apart!!!  LOL

 

We decided that same day to get married.  Our interview was April 17, 2018.  I went back in May to get the license and returned in June to get married.

The standard isn't different -- each just looks at a different part of the process.  If they just looked at/did the same thing, there would be no benefit to having a two-part process.  (Of course, many believe there IS no benefit in that!)  USCIS looks only at paperwork to determine that, per the papers submitted, the petitioner and beneficiary have the required relationship for the visa (fiance, spouse, parent/child, etc.).  The consular office conducts the interview to determine if the beneficiary qualifies for a visa.  They review the documents and the relationship based on knowledge of local customs, Iaws, and - usually - language.  Plus, they determine if any of the ineligibilities that prohibit visa issuance and entry into the US apply, whether the relationship appears to be genuine, etc.

That's my point! There should be just one Agency that processes a petition AND a visa. What is the point is having a petition approved then a visa denied? To me, it's just the more steps, the more agency and the more fees you have to pay Uncle Sam.

Timeline

Things like this make me very nervous. I will be soon scheduling my fiances' interview in Manila. I will attend as well. I got an RFE cause I did not list my e-wife's petition from 2000. I did not recall what forms I submitted and thought only K1 has to be listed. She came on a K3. I had to send the CSC a letter why I omitted the information. I sent and they approved the petition. I hope this does not become an issue at the embassy.

This is connected to your 212 A(5)(a). I’m guessing that two petitions in 2 years from 2 different fiancés doesn’t help the case that they believe you are trying to come to the USA for economic reasons and not for love. 

 

How does your fiance feel about moving to the Philippines?
